I have read all the threads about Australians travelling to USA with criminal convictions etc. However, what about if you want to get into Austrlia with a conviction? As a UK citizen with a DUI in the USA, that conviction will not show up on the UK police database (I believe). Will it show up on Australian immigration systems?

A DUI is the worst and stupidist thing ever and the ramifications for getting into the USA are huge. However, views on Australia would be welcome.

Welcome to AFF SmilerUK!

Have you tried looking at Department of Immigration and Citizenship?

There you will find the ETA form or Application for Electronic Travel Authority which asks for criminal convictions in question 25.

Personally I do not believe that a DUI conviction would exclude you from entering Australia and unless you spent time in jail is not regarded as a serious offence.

I went to the USA on a VWP and declared I had a crinimal conviction (DUI) tthe green form. I was interviewed by an immigration officer for ~30 minutes and was allowed entry to the USA and was told next time not to declare that I have a criminal conviction and to have the court papers with me.

I have been to the USA since and did not have any issues.

JohnK thanks for the reply. You have been extremely lucky getting into the US with a DUI especially when interviewed. My experience is somewhat different especially as the conviction was in the USA.

Key question is getting into australia. Morally/Legally absolutely you should announce it and under the Australian requirements a E676 VISA should be applied for. However, my experience of getting a US VISA (post DUI) has really hit me hard. Suffice to say that honesty is not necessarily the best policy. Hence my dilema. Risk not disclosing it as it wont even show in UK or be honest and potentially find it is a major deal!

Yeah, agreed with JohnK. You can contact with the department of immigration and citizenships. They will suggest you correctly.

JohnK response it very helpful. however, it really depends on what conviction level you possessed, therefore, if you've been banned to Australia by the US, then you cannot enter the country.

That does not make sense.

What does "you've been banned to Australia by the US" mean?

"you cannot enter the country" ... what country?
