BNE Parking Infringement Notice - what is the status?

Recently while parking at DFO Brisbane I do recall seeing a "Tow away 2 hours max" type of sign when I parked. When I have returned late to the car there was a ticket on the windscreen.

There is lots of info on the notice about Airport Act 1996 (Ch), payment instructions and consequences.

I've also seen recent media about the 'fines' issued by private operators not being enforceable and that Qld Transport has stopped private operators from accessing the vehicle registration database to obtain car owner details. BNE Airport Corporation does work like a private operator.

Now I'm wondering if that ticket needs to be paid. There is some wording on ticket which makes me think it may not be enforceable as it is a private operator.

Anyone have any experience on these 'tickets'?
 
Without knowing the exact specifics of your situation, a private company cannot issue a "fine" in Queensland, as only government entities or courts have the authority to impose fines; a private company can only issue a payment notice for a breach of contract terms and conditions, which they would need to enforce through the courts if necessary.

It is unlikely that they would take you to court.

They rely on the gullible nature of some people who mistakenly think they must pay this notice like a fine.

They could also then not allow you into the parking facility again.

BNE is operated by Brisbane Airport Corporation, an unlisted private entity. It purchased a 50year lease from the Federal Govt until 2096.

However, the Federal department of infrastructure regulates parking and enforces PINS at various airports including BNE, SYD, OOL, LST, HBA, MEL, PER, TSV.

It’ll probably cost them more than $156 in labour, if you include what they’ve already spent.
I borrowed Mum’s yellow 1977 Cressida yeeears ago & went to a shopping centre, weeks later a private company running that car-park sent a fine for parking illegally, I was rather WTF and chased it up … it was a green Falcon that’d parked illegally, most likely matching interstate plates or very similar plates written-down badly. Coincidence much?!

Or they can tow away your car if you go into that car park again.

I've seen it happen at a Wilsons parking site in Canberra near where I used to work. Some people had obviously run up "charges" and ignored them. I noticed one day bright pink A4 size notes stuck to the drivers' windows spelling out what was going to happen if they parked there again without paying said "charges". The next day I saw a flat bed tow truck winching a car up onto the truck. It is legal for them to do that, as it's under the terms and conditions for entry.

Yes that's a " gotcha " if the dfo is on the airport.
Punishment doesn't fit the crime, it's just an open area shopping centre carpark a long way from the airport but...Pay it. (Checking into the Novotel there might have been cheaper!)

With a frequent free shuttle bus to the terminals, the exact same bus that does the terminal transfers.

Its part of the airport's commercial precint. The area designated as the "airport" is often more than the terminal and runway envelope.
But understandably the PIN can look like the private operator trying to pull a fast one

Ir makes sense that there is enforcement of parking rules at privately run airports for obvious reasons. Imagine an airport withour enforceable parking rules
