Whilst this is the letter of the law changes are often allowed and is even part of a yield management strategy. There is no point, particularly during busy periods, in letting aircraft depart with empty seats as they are described (within the industry) as a perishable commodity.
Conversely if they start letting people such that it is commonly allowed, then there would be no incentive to purchase the expensive tickets
