Remedies for a breach of section 18 of the ACL are outlined here:
COMPETITION AND CONSUMER ACT 2010 - SCHEDULE 2 The Australian Consumer Law
They include rectification.
It's not a question of rectification. As I understand the background, you accepted their offer to purchase 4 bottles for a certain price. They delivered only 2. It is a question of performance of their obligations under that contract; viz delivering 4 bottles.
There's a dispute as to how many bottles were being offered. CM was offering two - Dr Ralph intepreted the offer as four. This has already been discussed - when CM put an "x12" symbol on their wine, they mean 12 bottles. When they put "x2" it means two bottles. Not two packs, two cases or two pallets. Obviously that might be interpreted otherwise by the reader.

I haven't seen the terms of the offer, but what CM intended to offer is strictly irrelevant. If the objective interpretation of the offer is that 4 bottles were offered and Dr Ralph accepted that then there is a contract. But the converse is true too.
Anyone have any intel on this?

I'm halfway through a case of the hay shed and its been decent without being spectacular. Probably a decent price on that.
The oakridge is pretty tempting although with wm I'm always waiting for the next 20% off sale...
You could try calling Langton's about the pinot mix. They offered it to me despite being out of stock on their site. :|
Hardly available anywhere else on the market, the cheapest I can see it anywhere online is $68. To snap up this sensational wine for over half price at just $36.99/bottle . I only have 40 six packs so it won’t last long!
Edit: Cracka called me - Brookland Valley Reserve Cab Sav
Hot off the presses - and I know youse have all been waiting for this to surface - get your yellow tail here.
URL definitely not working for me.
Would appreciate a screen shot if you have it.
Looking at every other gift pack available here:
https://www.cellarmasters.com.au/gifts
The say 'twin pack' and then they write x 2 in a grey circle. To me this indicates that there are 2 x twin packs which happen to have 2 bottles in them.
They do however list 'From 14.99 a bottle' for a total price of 29.98 (using the Dorrien Estate Twin Pack as an example).
But that logic doesn't work.
Look at this item:
https://www.cellarmasters.com.au/gi...l-ouverture-magnum-glasses-twin-pack-GROTMAG2
It clearly says 'twin pack' x 1. Therefore there is 1 x 2 items for a total of 2 items.
If you write 'twin pack' x 2 then there must be 2 x 2 items for a total of 4 items.

The problem is that I didn't buy anything from Dan's yesterday, online or otherwise, and certainly not for that amount. I don't see any charges when I look at my accounts. Should I be concerned?
