Jury Duty

If you really want yo cause trouble, you can read up on the current major cases that have been in the news, (major ones that cause trouble) and bring that up in conversations at t he picking of possible jurors.
The SCs from both sides can vet potential jurors.
---
Even if you are called for stage 1, you can still be excluded, prior to the case going to District/Supreme Court hearing.

Does acting weird (or doing "weird and wonderful" things/acts) and getting nabbed by the Sheriffs officers worth it and does it work?
...
Ah, grin, I feel my honored colleague Forg SC might have nailed it.
Stand up and offer to make the Judge and/or everyone a cup of coffee each.
===
As everyone and nearly everything is xray ed its impossible to bring or take a lot of things into court these days.
Ie I dont think a Lawyers Wig if not a barrister or solicitor is allowed to be taken in.

If you’re a sole trader you’d be scrood, but if you’re on a salary is it legal to not be paid?
Or do companies have to retain you in the position but it’s OK for them to put you on unpaid leave?
They have to retain you and you get a wage, for me it was something like $250 a day which is less than half of what I'd usually be making, very poor financial choice for me to serve in a jury.

If they want to have a jury that isn't just retirees and students, they really need to match your current salary or average income otherwise you don't have a representative spread of your peers which defeats the purpose of a jury.

I've heard the concept of a professional jury being established but that's a topic for another thread haha.

For those who want a light hearted look at jury duty i highly recommend watching Jury Duty on Amazon Prime.
Basic premise is it is a hoax reality show, where everyone in the show is an actor except for one guy who doesn't know everyone else is an actor.

I don't want to cause trouble, just want to be excluded - as I don't need the $ 😂

Good to see everyone trying to shirk their civic duty. Imagine if you were falsely accused of a crime and all the smart people around managed to get out of jury duty.

Isn’t an official term for jury “the 12 people who were too dumb to think of a way to get out of jury duty”? 😏

Having property in two states has always saved me. I’ve just sent a rates notice and said I will be relocating.

It might be inconvenient if you've not got a legitimate excuse, but it's not that bad that you'd need to resort to dishonesty to be saved - or thought of as smart.

I’ve received two notifications of being in the window for selection (or whatever the correct term is), but only one occasion where I was actually called up. I was keen to go and do it and to see what happens.

Unfortunately my boss at the time wasn’t having a bar of me being away for the planned two weeks of the trial I was called up for and I had to use my automatic exemption… 😞

I recall that had I been empaneled, I would have continued receiving my salary and not been given any court allowance.

In Victoria the courts will pay you $40 per day and your salary should make up the rest (of your normal salary). You might find it isn't even worth your payroll department's time to make that adjustment.

There are ways to be excluded.
Also exempted for life.
Giving up Aust citizenship, (((officially you can reapply for it, but you get taken off electoral rolls))), if you dont ever plan to travel int again.
But it's very tight, ie excuses.
Being convicted of fraud is one, murder another, religion, essential work travel, job esp if national security of course, etc.

On the ABF website, if you renounce Aus citizenship while in Aus, you are issued an ex-citizens visa, can remain, but if you go out of Aus, you will have to reapply for Aus citizenship as an ex former citizen.

Not specific to fraud though @AustraliaPoochie but I think a conviction resulting in a custodial sentence of a certain length would be the threshold that results in disqualification. I doubt religion would be on the list of reasons though. The exclusions are more about being incapable to be a juror, don't speak english, mental impairment etc, rather than philosophical objections. A bit like occupying an exit row seat.

update: a huge relief for me :) We were in the city so decided to find out where Dowling court was for my jury duty later this month. Hubby asked a sheriff that since we would be away on a short trip during the expected trial time of 8 weeks, would I be able to ask for a shorter trial. They took us to the jury duty area and said a sheriff might be abe to help me. The lady sheriff asked me how old I was. I told her and she said she could put in an exemption for me as I am over 70s. I said that was not on the website about age. She said they don't publicise it because many retirees want to do jury duty! So, that was it ... I am officially off jury duty :) Stress over!
