Need help USA ESTA or go for Visa?

Do the Visa this time without the short cuts as getting deported would not be funny.
You will be ok if you set out the facts.
One of my staff members (former) was deported after several days at an airport hotel and return flight all at his expense as he lied in the interviews.
 
You are at the understanding that i am out to break a USA law by lying "so try my luck" ? Where did you get that impression?

I need the rule on arrest or conviction to be explained to me before i choose my visa options.

If an arrest with all charges dropped and no conviction no matter how old, are included in the ESTA rule then i will take the correct path of applying for a visa.

No-one in Australia other than US embassy/consular staff can give you an answer on this. We can interpret and even the barrister that you are seeing can only interpret. Your barrister may give you advice of what he thinks but he wont be facing the US immigration officers on arrival.

These are the facts:

- You have been arrested
- If the US immigration staff are aware of your arrest (unlikely but we don't actually know) they can refuse entry
- If you are refused entry to the US it makes it very difficult to obtain entry again in the future

I think the phrase "try your luck" was meant to imply that by not getting a visa or getting advice from the US embassy you are taking a gamble as you do not know if you will be granted entry. If however you do get a visa you will be granted entry.

I believe what russ was attempting to say in the now deleted posts is that anything you get from the forum is really only the opinion of forum members based upon their readings and real world experiences.

Take this information as you like but the only clear and definitive answer to your query will come from the US embassy/consular staff.

You're correct. But his attitude has left me with a more "Push your luck" and let karma sort it. :-)
