NZ Car Hire Infringement notice accident-hirer to pay full cost of car

Hello all, I will be hiring a car with $0 excess insurance in New Zealand soon but one part of the rental agreement is bothering me. It says, "Insurance Exclusion applies where damage, injury, or loss arises when: "In the event of an accident where the driver is charged with an infringement/offence, the Hirer’s liability is increased to the replacement cost of the vehicle or a minimum of NZD $5000". Is this standard in most car rental agreements?

Charged, not convicted / pleaded guilty? Doesn't sound reasonable.

geez that's rough. You can innocuously have/cause an accident but still get charged with an offence. For eg, failing to give way.

No wukkers with the Amex Explorer insurance though. It covers any liability up to the value of the value provided thats less than $100k.
 
Generally if you are breaking the law insurance is null and void even with private insurance.

Yes that’s my concern, accidental breaking of the law.
 
Have you looked at a third party for peace of mind, or even just upping coverage on travel insurance, can be much cheaper than anything most car rental companies offer

Yes, I have started looking at that however they refer back to the rental agreement in their fine print. I’ll keep looking…Im so different to my sister. She doesnt get insurance for anything!
