State border closures illegal under the highest law in the country?

Everything is arguable in law, doubly so in constitutional law. This is a matter for the high court.

But here's my opening argument;

Section 92 of the highest law in the country sets out "On the imposition of uniform duties of customs, trade, commerce, and intercourse among the States, whether by means of internal carriage or ocean navigation, shall be absolutely free. "

Per Cole vs Whitfield 1988 "The notions of absolutely free trade and commerce and absolutely free intercourse are quite distinct". Sec92 clearly sets out the law for interstate trade, but also 'intercourse'.

And on the matter of what intercourse means, per Gratwick v Johnson 1945 it's the ability "to pass to and fro among the States without burden, hindrance or restriction".

Border closures, (and arguably although less certainly isolation requirements), are therefore inconsistent with the highest law in the country and should be set aside.

No one is talking about it, any legal eagles here explain? There's no room on the news for this at the moment, but if people start to fed up with the restrictions, it's worth getting them tested in the high court.

I think this analysis will answer all your questions: States are shutting their borders to stop coronavirus. Is that actually allowed?

Short version: if there are good public health grounds (for example states of emergency), those laws are likely to be held valid.

Could be worth testing if an individual could be proven to be not a thread to public health, but that would be the exception. Thanks MEL_Traveller for sharing the article.

When I moved from SA, I had a real difficulty in VIC with "poo-el" instead of "pull" - (the place you go swimming- pool)

And then there is that place where children attend to be educated. And the big one for me - Marco Polo pool game but maybe that is a Qld thing.

South Australia could open its borders to residents of NSW and ACT as early as today following hints from Premier Steven Marshall yesterday.

Speaking to reporters yesterday, Mr Marshall said the Transition Committee would meet today to discuss coronavirus cases in those states.

"If they make a decision … authorising travel with the ACT or NSW, that will be made (public) immediately," he said.

"We want to give as much of a leg-up to those people who are wanting to travel for business … family reunions … as soon as possible.

"The numbers are looking really good, and it's obviously a decision that the Transition Committee needs to decide. But if they give us that advice tomorrow, we'll be very quick to act on that."

A decision is expected to be announced later this morning.

I think ACT Restriction will go immediately today and NSW in a week or so. Besides, NRL is about to announce today that a Rugby final is being played in Adelaide in November and of course the sporting world gets to find out these things first.

And the QLD premier was invited to answer questions on 7:30 to explain the rationale behind them for I think they said the seventh time and she dodged again. They made mention that every other premier has made themselves available several times but not QLD..... disappointing.
Must be taking learnings from the Peter Dutton interview on Insiders last Sunday.

I'm fine with that 😀. If borders continue to open we are at the stage where we know what to do and it is a fairer system. I am waiting for the chicken little brigade to start whinging once ACT and NSW are open though. However I am in a state of dissonance over the Indian Team coming here until International borders open up but on the other hand for our business, it will be a Potential goldmine for us.
 
ALLIANCE BLAMES QLD BORDER RESTRICTIONS FOR AXING ROUTE


Alliance has blamed Queensland’s border closures for its decision to suspend its service between Brisbane and Bundaberg.

The business’ chief executive, Lee Schofield, said that while the carrier maintained the Bundaberg service through the height of the pandemic earlier this year, recent border closures had stopped connecting traffic through Brisbane, making the route “unviable”.

“The decision to suspend services to Bundaberg was not taken lightly,” Schofield said.

So apparently another Press conference has just been called by Police Commissioner shortly. Wonder what happened within the last hour. Hopefully rockets up required orifices.

Police Commissioner doing a presser atm.Says he won't release the written medical advice he was given.Also says the decision was his.
So ACT OK.NSW can visit but must do 14 day quarantine.

Looks like the expectations about the announcement were a bit overblown - border reopened with ACT, but border with NSW will remain "indefinitely".


South Australia will relax its border restrictions with the ACT from midnight tonight - but restrictions on people from New South Wales will remain in place indefinitely.

I wonder what clinical evidence was used to justify the decision to keep the NSW lepers out of SA? How much lower do their cases need to get. seriously?

Haven't heard or had a chance to google to see what their rationale and explanation was yet or are they playing 'drop a bomb and run and hide' / 'I don't have to provide explanations for my decisions' from the Anna/Dr Young's playbook?

Queensland Government under increasing pressure over border closures, Palaszczuk accused of 'bloody-mindedness'


Greg and Gloria Newlyn are desperate to visit Greg's 93-year-old mother in Queensland. The Canberra couple have been told she only has a short time to live.

"She's very thin now and it's just surprising that she's actually still alive at this time," Ms Newlyn told 7.30. The Newlyns can only enter Queensland if they undergo two weeks in quarantine, even though the ACT hasn't had an active case of COVID-19 in months. "I think it's just bloody-mindedness by the Queensland Premier."

Queensland is refusing to negotiate on its tough border restrictions, despite ongoing criticism and questions about the medical advice behind the restrictions.

The Newlyns are not the only people unhappy with Premier Annastacia Palaszczuk's decision to keep Queensland's borders largely closed to residents of Victoria, NSW and the ACT.

Trish Schneider has endured years of pain and surgery from severe complications from a pelvic mesh implant.

She lives in the northern New South Wales town of Casuarina, just over an hour by car from her team of specialists across the border in Brisbane. Ms Schneider's home is within the so-called "border bubble", so she can actually enter Queensland, but only as far as the Gold Coast.
