I wonder when his mere presence is enough to satisfy breaching the 408 visa condition to 'not be disruptive'
He's not being disruptive he's appealing the determination through the courts. He hasn't been doing interviews disparaging the Government from his hotel room or otherwise causing disruption to the good order of the Commonwealth.
 
I recall the onerous visa requirements to get into Russia to travel for a fortnight (every employer/where you went to school/serve in military ?? Parents details Etc etc ). It was not until I made it to the ‘other side’ that I breathed a sigh of relief. It’s a naive assumption that getting into another country is guaranteed (even with all the ‘right’ paperwork)

I didn't mention the court action, I said mere presence.

Imagine another scenario, if he gets to play, wins a semi-final and then a brain-explosion at the court-side interview amounting to being disruptive.

We would have to ban most of the Open if that was the grounds for admission to the country.

Perhaps but anything covid-related is a powder keg. Even having fair comment about his neighbours would probably not amount to being disruptive (*this is not advice to Mr Djokovic)
 
I expect the Djoker will be perpetually disruptive towards the Cth of Australia, it's leaders, current laws and directives, once he is removed from it's territory. EDIT: I'd go so far as to suggest he has forever reduced his chances of #21 by 25%

Novak Djokovic's appeal against his deportation from Australia has hit an early snag, with this morning's virtual court hearing appearing to be overwhelmed by demand.

The link to the Federal Circuit and Family Court hearing either fails to load, or comes up with a message reading "temporary disruption".

A court spokesperson has confirmed the hearing has not started and said the court was aware of the problem and was working on it.

The current legal argument from Djokovic's team is being put forward. As I understand it they are arguing technicalities in the Act and construction of Legislation really and arguing that while the documents indicate the visa applicant "can provide evidence" doesn't mean "must provide evidence" and then therefore the refusal of entry is invalid. The judge seems well aware of the significance of the case beyond just Novak Djokovic.

On the other hand how many non citizens are allowed into Australia if they are vaccinated or have recently had covid.
