I still don't understand the issue here....if you don't want to be bothered by the window, why don't you just choose a window seat and keep the thing closed. Then it will never bother you.

If you want to sleep or work on your laptop or whatever then choose the appropriate seat for what you want to do.
guilting people out of using the benefits of their seat or its position, just because you don't plan your seat choice better is just plain selfish.
One can plan and allocate a specific seat, but as we know and the airlines will tell you, it does not guarantee you will be seated in that allocated seat.
And assuming seat allocations were guaranteed, what happens if there are more passengers who want a window seat but can't select one because all are already allocated? It seems unfair that the person who misses out on a window seat have no say in the shade position, yet initially wanting a window seat.
But more importantly, I still don't see how the person who sits next to the window (or any other passenger), be the sole legal custodian of the positioning of the shades for the flight?
As mentioned, there is no one size fits all approach, a bit of courtesy from all travellers goes a long long way - and hopefully simple reasonable requests whether for being up or down shade can be equitable settled.
