Jetstar in-air fight

Jetstar is looking to recover for the cost of the diversion. Given they had several options, did they take the most appropriate option?

If they pursue this and don't reach a settlement I am sure the court will decide whether their course of action was appropriate or not.

Perhaps we should all be sticking up for drunken louts, other passengers and the airline and its crew should just suck it up, and stop being such princesses about it. After all, probably better IFE entertainment than a movie on a tiny screen. Nothing like a bit of real life action and blood to keep things interesting .;):p:rolleyes:
 
Jetstar will be up against several difficulties if they try to use the law of negligence to recover the cost of the diversion. So I'm still not seeing why negligence rules keep being raised in this thread. They aren't relevant.

Their behaviour was a potential breach of the passenger conduct requirements stated in the Conditions of Carriage. The CoC also has a clause pertaining to the recovery of costs in the event of a diversion. Not sure where the negligence argument is coming in.

Can you quote the contractual conditions? I don't have a JQ contract to hand but I don't see any such conditions in my QF and AA contracts. And JQ will have to hope each of the pax bought their own ticket separately, otherwise there are going to be privity problems in arguing breach of contract.

Also of the five, who were fighting and specifically punching?

If all then fine, but if it were just two of them the other three would be mightily annoyed if they were adjudged culpable and deemed to have to pay part of any compensation.
 
She was negligent, and caused property damage and so she bears the consequential financial loss to put you back in the same position while the property damage is repaired. So yes, like that lady if we are talking about negligence and property damage. But no if we're not.

I'm just embarrassed for not proof reading. There is a long story involving my useless insurance company as to why I'm out of pocket for the hire care.

You also can't go out and hire a Ferrari at $2000 a day just because someone ran into your car. You have a duty to be reasonable in mitigating your loss.

It was actually a lower level car than what I drive, and I only hired it for the weekends when I was at home in Adelaide. Worked well, pick up at the airport and drop off to the airport.
