How on earth did he get a Visa to get into the USA based on his record?
 
From memory his good lawyers convinced the various judges not to record convictions.
 
This is a bloke with form for beating women.

ACTOR Matthew Newton allegedly assaults people who are older or not as physically strong, an expert says.
Danny Blay, the executive officer of Victoria's male family violence prevention association No To Violence, said it looked to him that in recent cases Newton had made particular choices about who he would be violent towards.
"They are less powerful and he assumes a right and entitlement to use violence towards them," Mr Blay said.
"He needs to be held accountable."
Mr Blay said in his opinion, the violence by the 35-year-old, 180cm actor was not a mental health issue.

If he has a genuine mental illness then I have some sympathy and do hope he can get it cured/under control. But whatever the situation is, he cannot be allowed to continue to go around assaulting people. Hence I think he needs to be placed in a position where he cannot do so, whatever that may involve.

Yes, it is - I find it unusual you would even ask! Not only did he commit assault but he also got a suspended jail sentence.

Getting a gaol sentence in itself does not prevent entry to the USA. The key question is whether one has been arrested for crimes involving moral turpitude. Hence my question. If he hasn't been involved in such crimes then the VWP would still be available for entry to the USA, in theory. Of course as a sports person he probably had some other visa as he will be working while in the USA.

Now crimes of moral turpitude is a poorly defined term. However, some guidance is available in Wikipedia as to it's meaning for USA immigration. If you read that simple assault is not a crime of moral turpitude. More serious forms of assault are, intent to kill, with a deadly weapon or intent to cause serious harm (inter alia). I can't exactly remember but I don't recall him being found to have any "serious" intent in the assault. It's not all that clear cut IMO.

BTW I think the guy should be locked up and I'm disgusted that he is representing Australia. Especially with some of the other athletes that have not been given a pass to London.

It's the fact that they are representing Australia, they should know better than take a photo like that - but that's not even my gripe. I want to know if anyone knows HOW he managed to get a visa??? Could it be that he got a special sports visa because he is representing Australia?

Isn't she the Commander in Chief of the British Armed Forces + a few others spread around the Globe?
 
I am sure there is some international agreement on visas for Olympics,world championships etc so I am not surprised in this case the pair got visas.
I am amazed in cases such as Ben cousins and Matt Newton,though possibly they got them on humanitarian grounds as they were seeking treatment.
And I continue to be annoyed at people acting as judge jury and executioner.This fellow went through the judicial proceedure and got his sentence.He then was disqualified from the Beijing olympics hence a second punishment.He then went through a Civil litigation and got a third punishment.Sure he declared bankruptcy-but he is a student who obviously hasn't a full time paying job.I think he is perfectly within his rights to do so.I would question the legal advice that he should be sued-the prospect of a bankruptcy should have been factored in to this advice.
And quite frankly I hope he does win gold.
