Ripped off by Qantas holiday advertising

I clearly understand that the double points offer is only for the QF Holidays part of the booking. Just because a less experienced traveller does not understand does not make them entitled to the double points for flights in any way.

What an average person would believe is quite key in a small claim and is a basis for whether a claim would be successful

Gday all,

An update to this issue.

I took my complaint to the ACCC many, many weeks ago. As luck would have it, they did actually heed my lone voice in the wilderness & took it to Qantas. They did let on that I wasn't the only one who had complained.

Alas, that avenue went nowhere. So I told the ACCC that I would be then be starting legal action (as suggested earlier in this thread).
So the ACCC said "OK, let's go back to Qantas then & see what they say..."

Time ticked on, and on, and on. Finally heard from the ACCC. Qantas have responded saying "yes, we will award points as a goodwill gesture".

That was great news, but I didn't believe Qantas until the points actually appeared in my FF account. So I waited, and waited. Finally called the ACCC to find out what's going on.

I checked my FF account a few days ago and BINGO!! YES I HAVE THE POINTS I WAS (I believe) ORIGINALLY ENTITLED TO!!

That's what I call a win for the little fella.

I think the fact that QF ignored the ACCC until legal action was threatened is disgusting, and says a lot about their attitude. It also implies that the ACCC can be a bit of a toothless tiger in some situations.

As I commented in the ACCC parking costs investigation thread it would seem like the ACCC is a waste of time and money...
 
The ACCC would not normally look at a case like this unless there were a number of people making complaints. Ordinarily they will refer you back to your state based consumer protection people.

Nevertheless it is good to see that you got the result that seems to have been promised by the promotion.

This is quite true and no amount of convoluted fine print gets companies out of a jam when their main advertising is false and misleading and undermines reasonable consumer expectations. A friend of mine was one of a group who took Amex to the ACCC some years ago over their "so called" free or bonus companion fares offered to Platinum cardholders. The ACCC forced AMEX to offer compensation. Strangely enough, even though AMEX have carefully changed their wording removing references to 'free' or 'bonus' they still tread a very fine line in this matter of companion airfares, my experience as a member of originally Platinum and now Centurion is that these fares simply don't exist in the form that is implied by the company, but do exist in a technical manner. As I said, it's a fine line.

Congratulations. Good to see that they capitulated ; shame that it needed the threat of legal action to get it done

Congrats.

Based on my experiences with the ACCC, I'm surprised they took up the case. Good to see a resolution in your favour though, and enjoy spending your hard earned points!

Good news indeed and well done. Great results for you and the FF community and it shows what forums like these can do to help the "little Aussie battler" - or should I say, a person truly reflecting the "Spirit of Australia". Also, nice to see that you were able to move ASIC out of it's comfy chair long enough to get them to finally pull their collective fingers out.

The ACCC rather than ASIC I think... ASIC actually have powers and on occasion perform an adequate function...
