Did they dump the branches back on your side?!! Not sure about your council but in mine anything you trim is yours to dispose of, not the tree owners. I'd be dumping it right back on over.
Apparently, from my admittedly basic reading, the cutter has the right to return the cut branches to the tree owner (in this case, me).
10% of what? Height of tree? Lngth of branch sticking over fence on his side?
A loquat tree and a 40yo elm aren't invasive!
If it’s growing over the fence into your property then you can trim branches and roots back to the boundary, without that pruning being excessive (often regarded as more than 10 per cent of the tree) and without harming the life of the tree itself.
[h=2]Overhanging branches[/h] It is every property owner's responsibility to make sure nothing escapes from their land into the land adjoining, including tree branches and roots.
If branches from your neighbour’s trees hang over your side of the fence, you can cut off the offending branches and place them on the neighbour's side of the fence. Discuss this with your neighbour first – they may be happy to do it themselves.
The same rules apply for tree roots, which can cause damage to plumbing and foundations. Expert opinions from plumbers or engineers are often needed to resolve disputes about what is causing the damage. Once you know what is causing it, and if it is something coming from the neighbour's land, a simple discussion may resolve things.
So 10 percent of the tree and they can leave the branches on your side.
