This is going a bit OT as it doesn't relate to new estates. But in this scenario where over the years a fence line has been set incorrectly, ideally everyone just resets the new fence line back to where it should be from the original title.

Unfortunately in the eye of title law it doesn't quite work like this. There is a law called Adverse Possession (Adverse possession) If that rickety fence has been at that position for the last 15+ years occupying say 30cm more of your land, the neighbour now in fact has rights to claim that land as their own.

It can get stupidly messy over +/-5cm's here and there when redeveloping in older established areas. Not fun!

That's why it is best to sort it out sooner rather than later.

From the pic I would say that your land has been cut so that next doors builder can easily run a trencher for the foundation of the garage wall to be located on the boundary.

Bet they don't make good what they have done to your land though once the foundation and slab has been poured.

I am doing both...5 week old and 1/3 way through custom build...not enough time in the day!
 
Well construction finally started yesterday...and ground to a halt today when the council issued a notice to comply, as the builder forgot to apply for an Asset Protection permit. :mad: Looks like nothing will happen until next week now as it will take a few days to get that sorted.:(

Ditto to FM. Thought you had finally started the build. How frustrating and disappointing not to mention annoying. :(
Hope it gets sorted quickly.
 
This builder does sound bloody unorganised!
I think the problem is our contract support person left, so we didnt get handed over to the construction support person. We've been in limbo for a few weeks and things got missed. I'm just amazed they started when they said the would.
 
Yep we do need a dislike button - hope that when it's finally built it will be worth it. I'm still debating as to whether to build again
