No new points for me (targetted, 5T/5K, but flagged for abuse). I did get the letter yesterday about not having been targetted - which is old news already.

But some fun offsetting news - just had a friendly call from our friends at QF to say I'd won seats in the A380 promo - London here we come :D Doesn't quite make up for the AMEX mess but I'm looking forward to the A380 regardless (pity it is in Y and not upgradable, but I can hardly complain).

BTW on my display at least, this message is fittingly on page 380 of this thread.

I know Amex can change the T&C's at anytime but are they allowed to backdate their T&C's like they have done?

I rang ASIC, who referred me to APRA, to ask the same question. Neither felt it was within their area, so I'll have to wait till I can lodge a dispute with the ACCC to find out. Does anyone else know (as supposed to have a gut feeling)?
 
If you have complained to Amex and not had an adequate resolution then you should complain to the Banking and Financial Services Ombudsman that has been referred to multiple times in this thread.

Retrospective changes without notification are illegal, under the trade practices act.

Notification must be made in a suitable manor so as such the majority of affected people would be aware of changes, i.e. mail, e-mail, phone call, etc, by simply placing a statement on a website does not meet required guidelines.

My short answer is No. Amex must think they can or they would not have sent out the retrospective letters.

It really is irrelevant at this stage as Amex is not budging. We have no choice but to wait until the complaint letters are dealt with by Amex or one of the government authorities.
 
Well, still no points posted to my MR account from 10/12. As of 5 minutes ago, transactions for 11/12 also not posted. Previously, I've had them post by 9.30am BNE time each day.

The posting of bonus points on 10/12 seems to have given the MR software a dose of constipation :oops:.

Whilst not seeming to disbelieve you could you clarify your degree of authority with this?

There has been so much BS posted here lately I feel the need to clarify who really knows what and who is plucking things out of their xx_x :confused:

I'm just reading a couple of section that I believe may be relevant. I'll be back...

(later) My reading of the Act makes me think that Section 45(E)(2)(b)(i) may respond, as well as Sections 51AB(2) (Unconscionable conduct), Section 52 (Misleading or deceptive conduct), Section 53 (False or misleading representations), perhaps Section 68A. The best one is Section 54:

54 Offering gifts and prizes
A corporation shall not, in trade or commerce, in connexion with the supply or possible supply of goods or services or in connexion with the promotion by any means of the supply or use of goods or services, offer gifts, prizes or other free items with the intention of not providing them, or of not providing them as offered.

Not sure whether their attempted changes to the T&C's may bring Section 45 (Restrictive trade practices) to respond...

If Section 54 responds, then the penalties are set out here:

75AZG Offering gifts and prizes
(1) If:
(a) a corporation offers gifts, prizes or other free items; and
(b) the corporation offers the gifts, prizes or other free items in trade or commerce, in connection with the supply or possible supply of goods or services, or in connection with the promotion by any means of the supply or use of goods or services; and
(c) when the corporation so offers them, it intends not to provide them, or not to provide them as offered;
the corporation is guilty of an offence punishable on conviction by a fine not exceeding 10,000 penalty units.

Lindsay we had a lapse of around 2 days earlier in the week but things are back to normal now. Probably just because they are playing catch up with the bonuses (bonii ;)).

This was also confirmed by the BFSO in various written correspondence prior to Amex reversing their initial decision to exclude me from the offered "Myreward" promotion

It has been my position throughout this thread that if anything catches Amex out, it will be any retrospective element to their changes. There have certainly been cases of businesses being caught out on this before.

My points have been posting as normal - all financial transactions are up to date as of last evening. I expect 3 more transactions and another 5K to post early this afternoon.
 
Just had a chat to the Amex CSRs in the Platinum Credit card services - they had a lengthy delay talking to MR and they said that all points under the promotions for September transactions will be completed by the end of next week. That for me is the date that I will lodge the complaint with the BFSO - if they do not arrive in my account by Friday. I've now raised my concerns with Amex, and if they miss this deadline, then I have a trigger for the BFSO.

The fair trading provisions of the TPA do apply to loyalty programs (remember this: ACCC ends investigation of proposed retrospective point value changes to the NAB Rewards Program)

"Loyalty program promoters risk misleading consumers and breaching the fair-trading provisions of the Trade Practices Act 1974 if they:

  • advertise awards that are not available as represented
  • hide in the fine print or fail to disclose the truth about the restrictions imposed on the redemption of those rewards
  • seek to retrospectively change programs or offers to the disadvantage of consumers.
"The ACCC will continue to monitor consumer complaints received about the operation and conduct of loyalty programs".
