Without Prejudice

For All AFF’s Information

I just got off the telephone from my mate at Gordon and Slater.

He advises me that they have been informed by AMEX of the change to the terms and condition to the promotions IE 40,000 cap for the promotion period.

They are now awaiting written confirmation of this.

In the interim they are putting together a list of aggrieved card holders to analyses the possibility of putting forth a Class Action against AMEX for breaches under the Trade Practices Act (Cth) in addition they would also look to represent card holders in relation to complaints lodged with the Local Regulators IE ASIC ACCC and Dept of Fair Trading in each state and territory.

I will let you know the website once they have loaded onto the web.

This email is just to keep you informed of events and options that you may wish to take. No Legal Advice is provided nor promises of a compensation payout.

And i'll garuntee that the ones who are looking for this now will be the first ones to whinge when they go bust and you get zip. Unlikely to happen i know but still plausible, there have been many big companies go by the wayside lately.

Interesting - since my last bonus (which took me to 40k of bonuses) - I have yet to receive any more bonuses and I have 5 transactions since then. Normally my MR points update around 9AM but the two transactions from yesterday have not accrued any points yet.

I will check again later.

I wouldn't be too concerned. I expected our second lot (total 10K, so way off 40K) to post this morning, they haven't.

I wonder what the trigger point would be - 5 transactions from the same merchant in the same day would be my guess.
Why is 5 transactions suspicious? If I go downstairs to have a drink I can easily have that many beers in a couple of hours before closing time.

it is pretty easy for amex to check their database and see who got the postcard sent. i guess at the end of day, if amex really want to find out, they will.
Whether you received the postcard or not is irrelevant. Luisa mentioned that anyone already signed in to the promotion is eligible. I don't know what happens to people who have not been targetted and have not been able to register. I guess it is too late for some people.

it takes about 2 days for the points to be posted, just wait a few days, if not, then bad luck.
Not necessarily. I got bonus points last night for the transactions that hit the account last night.

I could not care less if Amex has changed the terms and conditions because some people chose to be greedy and abused this promotion. I would be grateful if I could earn 40,000 bonus points by the time the promotion ends.

The offer was still available on the website (I did a screen print) after Luisa had made her comments. Just to clarify further on the restriction to targeted customers.

Normally my points hit at 9am'ish... nothing today, but I would expect with all the additional card activity overall that things may be delayed a bit...

oh well.... time to have a coffeee and will check later.

Im with you Simongr... I cant stand to change pages that often, so whenever i start a new forum the first thing i do is change the default layout to as many as it can handle, which sometimes can be up to 100.

Here here!

I can tell when the cookie expired on my personal machines when I balk at a topic like this spreading across umpteen pages with only ten mere posts per page!

If AFF could have a feature to have 100 posts per page, I'd switch straight up. But currently, I'm in the 40 post club.

no bonus points ave landed as at 10:18am :/ tic toc! must be alot to collate and deliver!

I've got my 2x5k bonus points posted this morning.

Though not all of my transactions in the past day are on my statement/MR statement yet.

But the good thing is, the bonuses are still ticking along.

Have not reached 40k yet.

This does show a slightly farcical side to this promotion and the potential of a 40K cap. The promotion is due to run until the end of December and no new people can join currently.

A lot of people here are in the first week of the promotion (maybe second at most) and are already getting close to or have hit the cap. And there is still 3 months of promo to go...

OK - I just had a second between mind numbing SOX controls reviews to go and find the publicly available 5000 pts offer based on the screen print and the link I provided on page 7 and 8 (under a 40 posts per page view regime) and I saw there the T&C that I had not looked at before:

Terms and Conditions

Once registered, the total transactions on your American Express Card must exceed 4 transactions in any given month between 10 September 2008 and 31 December 2008. There is no limit to the Bonus Points you can earn each month. Transaction count resets to zero at the beginning of each month. Please allow 8-10 weeks for Bonus Points to be credited to your account. All American Express Corporate Cards and David Jones American Express Cards are excluded from this promotion.

2. Membership Rewards Bonus Point offers are valid for purchases made in Australia and charged to an eligible Australian dollar American Express Card. Enrolment in Membership Rewards is required (an annual fee applies). Subject to the Terms and Conditions of the Membership Rewards program. American Express Australia Limited (ABN 92 108 952 085). ®Registered Trademark of American Express Company. americanexpress.com.au

That really does seem very clear to me.

You can also get the T&C for the 5000/10 offer by changing the end of the URL from "fivetimes" to "tentimes".

simongr: Yes, the T&C's are very clear, that is what we were discussing many many pages back.

The T&C's as on the postcard and website, state NO LIMIT
Several reps on the phone indicated a 40K limit
Several reps said there would be letters in the mail this week advising of the new T&C's

All we are waiting for now is to see IF the letters appear and when the limit kicks in, IE 1st October, immediately etc etc

Also waiting to hear from people who have gone over 40K, I think there is one on here ?

It is clear and always has been. As far as abuse of the promo is concerned (deliberate bill splitting with the purpose of increasing transactions) that could be dealt with under the T&Cs of the Membership Rewards (my bolding).

I realise that - I am still surprised that the website is still available and shows no limit.

Mind you I have had no MR points credit this morning :'(

Having said that... If they are sending out letters to amend the terms and conditions... Wouldn't their absolute first step be to remove the website advertisement... Even if they hadn't formulated the new T&C yet... just get rid of it... ???

If they are amending the T&C this seems highly negligent on their part

But the website is not avaiable to click through too anymore is it ??

I haven't seen any adds for it, we can only find it because we know the exact website address

Well I have cracked 200K in AA now with my most recent transfers thru SPG so I can wait another 8-10 weeks for unlimited bonus points ;)
