The CSR represents Amex, they provide information to Amex's customers (us) and we act in good faith upon the information that they provide. I don't believe the law makes a distinction between the salary or management level of the employee as to whether the information they impart is relevant - the CSRs are providing information based upon company decided policy. Perhaps I ask to speak to Mr Amex CEO to clarify the situation? Or maybe you could try being a little more pragmatic

Pragmatic... you record a call, over a telecommunications device (which is illegal - maybe try doing a google search and learn something for yourself) and you come across as an expert....

Advice was given in a friendly manner to assist you, yet, you know best.

I really hope you get the opportunity of seeing if this recording will assist your case in any way, as I know full well, that you will come crashing back to earth with a thud when somebody else tells you exactly what I have said previously. Only so much help can be given to some people...

If it helps, try searching ACIF (now Comms Alliance), ACMA etc, I must say a lot of boring reading material which I have on hand, however you may get the jist of what has been said, and learn that it isnt myth or fiction, it is fact.

You also tried to comapre a phone recording compared to recording a meeting.... the denominator here is the phone part.

Anyways, back to the Amex circus... I tried to help...

I joined 18 Sept, have received 50,000 points and didn't get a postcard. However I have funnelled all expenses through my card, no naughty stuff and even walked out of non amex stores and sent their details to amex. I have done my bit, and will continue to do so, I expect them to do "their" bit as well. Otherwise I would have no hesitation in taking appropriate action.

Correct, but any letter received will be to say there is a cap or some sort of limit, otherwise no need for a letter

Oh I am still waiting for the phone call that another person on here said that an AMEX CSR mentioned would happen

Yes Rambo, me too. But that link refers to the 2nd T&Cs, if the info I was given is correct (and it really sounded like the CSR was confident) there is now a 3rd for pre 20th Sept non-targetted cardholders.

My only regret is phoning and asking, I wish I had waited for Amex to contact me. As of today I'd say I have been advised.

Amex have yet to issue online, or by post, revised T&C (or at least I have not sighted any) to cover the preSep 20 Group.

Apart from the No Limit part and caps or no caps...there is now lots of extra fine print that needs to be applied and communicated. Remember that the majority of registrants will not have read this thread or even perhaps any internet forum, though yesa high proprtion of non postacrded registrants may have read at least one forum. people wi have without this or other forums have regsiterd family and friend, and wirkmates etc will have been told about the offer.

Once they do you will be able to ascertain whether you are in or out. The T&C when issued should make it clear.

It will need to be clear as Amex knows via this forum that people will go to the AAAC etc. So their new T&C will need to be clear and specific.

I really think AMEX needs to get their act together.

This is beyond a joke and any changes to the original offer will not be taken lightly :)

You know, I think what they actually done is created new promotions and stopped enrolments in the old promotions. The new T&C's have a different promotion name, and the opt-in codes are slightly different.

Might help Amex keep things on track. It's a pity the train de-railed quite a few miles ago...

"I signed up by 19 SEP, got a postcard, so must be on the old, unlimited' promo!"

Came back with a new option: I did not receive the card, but signed up pre 19 september, so I would be capped. He got confused when, I explaind him, that i signed up BEFORE the 19th.
Anyway, will be than a surprise to see what will happen it 8-10 weeks.
In the meantime having a closer look at the new Earth offer (20.000 points!)

I found the guidelines and skipped to the flowchart (pictures are easier) on participant monitoring. Note it is 'participant' and not secret monitoring by a law enforcement agency or anything else or whatever or the other thing or that whatsit. Oh my god, I cannot believe the number of disclaimers I have to add to post these days.

The first check, before any of the complicated State/Territory laws and such, is:

Express consent of knowledge of all parties to communication = Lawful
 
That is not the case.

To be able to record a telephone call, you either need a warrant, or a licence/authority to do so from various government bodies.

There are 3 main exclusion clauses apart from those required for law enforcement, and none of those include personal use or gain.

You also MUST have a secondary line immediately available that is unrecorded, which is an issue if using a hand held, or phone based recording device.



Please don't take this as being rude, but after having over 10 years experience in an occupation enforcing these laws, I will assure you, you can and will be prosecuted if caught.

I feel it is prudent that members here know that, and dont get caught up in any hysteria over trying to prove something which may get you into a lot of hot water.

Not to go too far off topic, but i know for a fact that where i work we record conversations, only when the other party is informed and they consent. And it is totally legal..

Except for the extremely limited exceptions referred to in Clause 6.1.4 below, all
parties to a telephone conversation must have actual knowledge that the
conversation will be Monitored in order to avoid contravening the prohibition
against interception set out in the TIA.
It's when you don't inform or have consent you are breaking the law.

Anyway Amex would be recording the call as well and would have it on record too.

I couldnt believe my eyes when I saw that golden postcard in the mail on that sunny afternoon!!
Does anybody know if I ordered a second card, the points can be earned on that one too? Thanks in advance.:D

If you get a 2nd card and attatched it to your current membership rewards account you MAY be fine, but who knows!

No-one can work out if one card will continue to get points at this stage :evil:
 
Amex tactic is to leave customers in limbo till the promo is over

In my Opinion Amex will leave us (the Pre-20th) in limbo for the rest of the promo making us self-regulate and reduce the No of transaction we make, because we wouldn't have a clue where the limit of this UNLIMITED promo lies.
That may sound like a very good idea for Amex. However, it is completely unacceptable for consumers to be enrolled in a promo with hidden T&C or T&C that can be changed to suit the moment at any given time.
How hard is for these people to send us a written confirmation saying if we are either IN or OUT, and a Black&White description of which transactions will count and which wont... T&C covering issues such as Multiple shopping trips per day or small fuel topups, and Bill payment in instalments and some other major rules ... at least a good page of clear to understand rules to play the game and try to make the best out of this UNLIMITED points offer that now is Faraway from Unlimited and starting to feel like a scam. Some people may loose money trying to use only shops that take Amex with the illusion that they will be rewarded OR end up loosing their Credit card after they try to squeez as many points as possible...

PLEASE AMEX make the UNLIMITED Points offer clear for the pre-20th or Modify it once and for all.

Whatever you do AMEX do it in WRITING and SOON
 
Hi All

I just faxed my letter to ASIC to complain about AMEX

Main point of my complaint was people are incurring debt to increase the number of bonus point which could be detriment to their current financial position and therefore ASIC must act as a matter of urgency

I suggest to all to either Fax write or email ASIC the more people that do this the more ASIC will Act

ASIC only like to catch big fish as small fish dont reward them with new budget allocation of money Get ASIC attention and they will act

Having worked for ASIC for 5 tears (admitedly in the early 1990's) I do concur with your assesment that they "only like to catch big fish as small fish dont reward them with new budget allocation of money". However I for one would be extremly surprised if they did anything more than refer the matter to the ACCC for response given the nature of the complaint (dispute over promotion rather than an allegation of criminal fraud). I hope I am wrong and wish you luck.

Bonus points - have you received them?

I enrolled on Sept 20 via phone (darn should have do it sooner, anyway..) and noted that according to the postcard the bonus points may take 8-10 weeks to post.

However I recall many AFFers have already received their bonus points by checking the Member's Reward (MR) site.

I just checked mine and there was no bonus points what-so-ever.

Before I waste my time calling AMEX to verify if I'm enrolled (I'm sure they'd be sick and tired of it by now), could anyone who enrolled on/post Sept 20 advise me if they have received their bonus points, and if the points are visible on the MR site?

I spoke to AMEX to clarify this point you made rodgerbranch 2 days ago and he said that anything like multiple 5c transactions and paying phone bills in dollar increments was unacceptable but making as many purchases in wollys or coles is ok. I even asked him if i split the shopping into 2 so 2 different ppl could get receipts is ok and he said yes... This obviously may not hold up! I think it will just be the blatant abuse that will be dissallowed and points deducted. How can they decide on your spending habits.

You are the one who has been ramming the T&C down everyone throats for days now. Come on, please give us a break. Most people here aren't stupid so don't treat them as such.
If in deed there is a problem and not everyone believes there is, and AMEX quickly setup new T&C and get them wrong then people such as yourself will go ballistic but at the same time you won't give them time to get things right.

That is a good point. Will it be transactions posted before the end-of-month or transactions dated before the end-of-month?

I am sure someone will be talking with AMEX soon, can you check for us.
