Any attempt by Amex to retrospectively cap the number of points under this promotion is a very risky move from both a legal and customer relationship standpoint. This is exacerbated by the fact that Amex has not made any attempt to formally notify their customers of the new T&Cs (a short FAQ on Amex's web site falls well short of the mark).

Should Amex continue down this path, it would not be practical for me (or for most other customers I suspect) to bring a claim against Amex for breach of contract. Rather, I will referring this matter to the ACCC on the basis that Amex has engaged in misleading or deceptive conduct. "Consideration" is not a requirement of a Trade Practices Act claim.

If enough people complain, it will certainly get the attention of ACCC who will in turn take further action against Amex if appropriate. Take it from me, a letter from the ACCC is taken *very* seriously by all corporations irrespective of size. Going down this path also means that cardholders will be able to rely upon the significant financial and legal resources available to the ACCC.

For now, I am sitting tight to see how this all plays out. I am hopeful (though not optimistic) that Amex will still do the right thing by its customers.
 
Pre-20th QFF AMEX People

Given I signed up to MYREWARD based on the public URL http://www.americanexpress.com/australia/campaigns/mrbonuspoints/fivetimes.shtml (note, nothing is there any more, so it's not worth visiting the link now), which clearly set out the terms and conditions which were valid at the time that I signed up, I do not think that I wasn't targetted matters. It was a publicly available URL that I visited, that gave no indication of being targetted. What's more, I went and logged in, and captured a screenprint (in PDF) of the notification that


1. In order to qualify for the 5,000 Membership Rewards Bonus Points promotion, you must register with American Express between 10 September 2008 and 31 December 2008 for the promotion. Once registered, the total transactions on your American Express Card
must exceed 4 transactions in any given month between 10 September 2008 and 31 December 2008. There is no limit to the Bonus Points you can earn each month. Transaction count resets to zero at the beginning of each month. Please allow 810
weeks for Bonus Points to be credited to your account. All American Express Corporate Cards and David Jones American Express Cards are excluded from this promotion.
2. Membership Rewards Bonus Point offers are valid for purchases made in Australia and charged to an eligible Australian dollar American Express Card. Enrolment in Membership Rewards is required (an annual fee applies). Subject to the Terms and Conditions of

I do not believe that because I did not receive a card that I am not registered to receive the full benefits of the original T&C of the promotion.

People have posted that their participation in this promo was cancelled because they were on QFF Cards.

Well, if what beardoc says is true then the original T&C did not exclude QFF Cards

Yes, I am doing the same for the moment. I am expecting that for the pre-September 20 crowd (before automatic registration was disabled), that Amex will be keeping to their part of the bargain and NOT retrospectively changing the T&Cs.

Otherwise, I can imagine that there would be a series of complaints going to the ACCC/Fair Trading Deparments and the Financial Services Ombudsman. All of these complaints would lead to an opening of "systemic problem" investigations, which can be quite involved (I've been party to a number of similar complaints with the Telecommunications Industry Ombudsman as well).

I am hoping that it will not get to that.

HAS ANYONE RECEIVED AN INVITATION CARD TO JOIN MY REWARD PROMO?

did they ever sent Myreward Invitations to anyone?

Caps wont assist getting people to read your posts if they have put you on ignore. Use of appropriate English and grammar may assist but I am making no commitments in that regard.

Not strictly true, as this officially is a Membership Rewards promotion, and the QFF cards are not enrolled in Membership Rewards.

That they did, however, does not constitute a waiver of any term and condition (as per the MR and QANTAS Amex T&Cs).
 
Incidentally I got bonus points over recent days and Amex transferred them to my ff program.

I'm guessing you are one of very few people to have received any bonus points from these promotions in the last few days.

Like others, I am going to wait the 8-10 weeks and see what posts in my account. I know what should post, and I have no reason to doubt that they will post, so just have to sit an wait (and spend to get more)

Click on the user name, go to the profile and then click on user groups next to the name and add to the ignore list.

Remember though that doesnt help if someone quotes the user quoting the T&Cs for the 15th time ...

Two things so YOU understand:

1) the FAQ pages refers to the Post 20th of September. Some Pre20th have a hope they be allowed to stay. Remember, there are QFFAMEX and Corporate Amex People in the lot (I follow more than 1 forum)

2) Even if they allow everyone Pre20th to stay as initially signed, there is THE BIG QUESTION THAT STARTED ALL THIS CHAOS "What is the T&C small print if any? "

For example they haven't communicated to anyone yet (IN WRITING) what the conditions for Min-Purchase or Max-Transactions are... It has all been Verbal info or Web published pages that change by the hr.

They are Dodgy trying to convince us the new T&C were communicated to people from the 20th when they certainly Didn't (have a look at post during the dates 20-24)

You can make your own idea of what the T&C are and go on a shopping bonanza for points. I would, and many of us would If we knew it was a real unlimited points offer with no conditions. But Amex doesn't want to clarify so we stay in limbo forced to self-regulate until the end of the promo.

This is an actual Cancellation of the Unlimited Uncapped Promotion without having to touch the T&C</SPAN>

I can't believe i am even replying to this but I'm bored so here goes...

The FAQ (the link is on the my rewards page of all pages) states:

What do we mean by eligible transactions? We mean the types of legitimate purchases that you make everyday, like buying a coffee, picking up lunch or a movie ticket.
Unfortunately we've identified cases where Cardmembers have been found to have intentionally manipulated transactions in order to obtain additional bonus points. For example, splitting a bill that would normally be paid as one transaction into dozens of small transactions.
Can it be any clearer on that?? Normal transactions.. is that clear enough for you?

The rewards page says this:

The amended terms and conditions apply to all Cardmembers who enrolled in the offer from Saturday, 20 September, as advised at the time of enrolment.
Now it says nothing about the people who signed up prior, but it also doesn't say that they will have their T&C amended.

I am doing my normal spending I usually do, except I am using the amex where possible.

Also this isn't "game" as you keep referring it to.

In short I have received no invitation from Amex on this promotion, can I still register for the capped program or am I not eligible alltogether.

Yes, people did receive postcards for MYREWARD. You'll see it early in this thread.

I would prefer to hear from people who did receive the Myreward invitation rather than searching 1740 posts :mrgreen:.
