Just because the media's misreporting gives me the irrits. He can't get an injunction against the decision but he might be able to seek an injunction against being deported before a hearing takes place about whether the decision is valid. That is what happened last time. He got an injunction stopping him being deported before last Monday's hearing had taken place.

🙄 all that wasted lawyers' time carefully crafting the govt concession so that it was on unreasonableness grounds not procedural fairness ... even their own client doesn't appreciate their efforts 😢

I had read somewhere that a Ministerial decision cannot be challenged. Hope that is correct.
I wouldn't want to be sharing the cabin on EK409 with Novax.
If he is quick there is still a seat left in First Class.
 
I wonder whether a different judge is on duty this weekend and the minister waited for that.

Apparently it goes back to the same judge, from The Age:

"If the case does go to court, the 20-time grand slam winner’s legal team hope the matter could be heard in court over the weekend and finalised by Sunday, allowing him to play a match early next week if he beats the government for a second time.

The case would go back to Federal Circuit Court Judge Anthony Kelly (who overturned the cancellation the first time) for a hearing, but he then may refer it to the Federal Court. Sources earlier in the week confirmed there was a justice on standby to hear the case."

Very good question although he no doubt will be relying on the medical exemption clause that he used to fly in.

Aren’t they duty bound to do so given they brought him to Australia in the first place? Plus he was unvaccinated when he boarded in Dubai.

I am sure I read the Emirates do not require proof of vaccination, only a clear Covid test.
 
His ego is off the charts guys, no chance he will just leave on his own terms. A challenge is a given.

The government wins here even if he gets cleared by the judge again, the public will blame the judge, and will be absolutely feral towards him if he plays. Just imagine the crowd at the final.
