COVID-19 and Tennis

I'm not a tennis fan at all, and I visited the AO website for the first time ever the other day, and was shocked they publish each planners "winnings", showing NoVax having won over $145m! You'd think, in this current climate when people are struggling, putting this figure up is a little demeaning...or perhaps its just cynical me who thinks no one individual should ever be worth that kind of money..

I think that's pretty good value! Divide his winnings by the total number of people that have been entertained over the years watching his matches and it works out to a dollar per person!

So where to from here?​

As per the court hearing, Djokovic's lawyers have until noon to file their outline of submissions.

Lawyers acting on behalf of the Immigration and Citizenship Minister will then have until 10:00pm to file their written response.

In the meantime the court will also decide whether tomorrow's hearing will be before one or three judges.

If the court chooses the latter, then the decision cannot be appealed to the full bench.

Then it's all back in court from 9:30am tomorrow.

ABC journalist genius at work. D'uh. It couldn't be appealed to the Full Court because it would already have been heard by the Full Court. The High Court though, maybe, but that would be beyond ridiculous IMO. (As if this whole mess is not already beyond ridiculous).

Perhaps he'd like to pay for his legal team to take on the cases of his fellow hotel inmates.
I might be wrong but it’s now former??? I think (read somewhere) Djokovic is allowed to sleep at his rented property even under the current detention
 
He was allowed to sleep there on Friday night because by agreement he was not formally taken into detention until 8am Saturday. I have not seen anything in the court order about allowing him out of detention except for legal meetings at specified times. There was nothing in Kelly's J's order about being allowed back to the hotel after 8am Saturday. Not sure if O'Callaghan J has made any order about it.

Australia’s No.1 men’s player was again drowned in Djokovic questions on Saturday ahead of his first-round clash with Italian teenager Lorenzo Musetti.

After politely answering the first bunch, de Minaur delivered a line that left no doubt about his thoughts on how the world No.1’s anti-vax stance and visa status had impacted the tournament.

“This whole situation has taken a lot of spotlight away from us competitors,” he said.

“We’re here to play the Australian Open. We’re here on our own terms, ready to compete and hopefully have a very good couple of weeks.

 
Novax's written submissions have been filed but don't appear to be public (yet?).

There are some Federal Court orders up now and they don't (yet?) include an order for a Full Court hearing nor an order for Novax to be allowed out of detention tonight to sleep at his booked accommodation (noting that Kelly J's orders allowing him out to meet his lawyers had the condition of Border Force supervision). So unless something changes I am assuming it will be a single judge hearing on Sunday and that Novax will spend tonight in immigration detention, I guess at the Park Hotel.

And direct Indial phone numbers. IT will be getting some change of extension requests soon enough
 
There were some attempts at redaction of some things. Like Novax's date of birth (like that doesn't take 0.05 seconds to Google, and it can also readily be guessed from some file numbers ABF assigned to him), his passport number, phone number and address details. A less successful attempt to redact the name of his agent, as they missed one instance of it.

For some reason there seems to be great secrecy attached to the names of the 2 doctor "independent panel" because those names are redacted everywhere but their lengthy qualifications are stated in full, so again it wouldn't be hard I suspect to insert the qualifications into google and see whose names come up. But poor old Dr Caroline Broderick's name is plastered all over the place (the Tennis Australia doctor who wrote the exemption letter that the panel then had to approve).
 
I have no problem with anyone using the established court/legal system to make their case.

It is (was) simple. Double vaccination a condition of entry to Australia. He knew the rules. His choice. Making a fool of himself and his legacy,

Novak Djokovic’s case will be heard by a full court at the Federal Court tomorrow morning instead of by a single judge.
The Federal Court announced this afternoon the matter would be heard by Chief Justice James Allsop, Justice Anthony Besanko and Justice David O’Callaghan, who presided over this morning’s proceedings.
The tennis star’s counsel spoke in support of a full bench earlier today, but the move was opposed by the governments’ lawyers as it would remove both parties’ right to appeal the ruling.
The hearing will begin at 9.30am (Australian Eastern Daylight Time) and be live-streamed on YouTube.

Minister Hawke did address these and basically didn't bother to test them citing the public threat as the primary cause. Given the way his supporters reacted to him at the detention hotel, they're not helping his cause.

Further, this will be hard for NoVax to content, his real challenge is that its unlawlful, but the law is essentially - "its upto the Minister"..

Yes which is why I struggle to see how the Government will lose out here. Federal courts generally don’t ever reverse ministerial decision making. How many times have we seen those in detention, refugees, visa problems, and so on, take it to court and reverse any minister call? Never. And they have tried hundreds of times. The borders here are watertight.
