His Honour is now getting tired and cranky with SC Wood
His lawyers were certainly keen to keep the case from being transferred to the Federal CourtFew legal minds on some socials claim that if it’s transferred to the Federal Courts his chances are very slim.
Oh. That was quick.Few legal minds on some socials claim that if it’s transferred to the Federal Courts his chances are very slim.
Maybe they care little about pre-trial maneuversWe seem to have some brilliant legal minds (posting opinions upthread), who have until now gone totally undetected.
thanks @Anna - will it be a streamable event as the others were ?The court order from Friday night is here:
Things I was interested by:
The govt now has an SC (although Novax still has 2, not that it's a numbers game), and both sides now have 4 barristers each (plus solicitors).
The hearing will be in the Federal Court, which is a rung higher than the Federal Circuit and Family Court, but it isn't entirely clear whether it will be heard there by a single judge or by a Full Court which is usually 3 judges
Novax must file his written submission by noon Saturday
The govt can file its written response by 10pm Saturday
Novax agrees that his lawyers' oral submissions at the hearing will be limited to an hour
The parties want a hearing on Sunday.
I will have a look to see if i can find any Federal Court confirmation about the hearing.
ThanksDunno sorry. I can't find that the Federal Court has agreed yet to take the matter on, let alone made any hearing arrangements. I assume they will take it on, but it would be hilarious if they were too lofty and important to give up their weekend for something as petty as a sporting contest
As from 8am Vic time Novax is technically back in immigration detention, with permission to be under Border Force supervision with his lawyers at certain agreed places at certain times (those agreed places not necessarily being disclosed to the public).

The Govt will get the blame as usual.Polls suggest greater than 90% Australians want Novax out of the country, the government wants Novax out of the country, reports of tennis players many whom vaccinated to be able to play in Australia want him gone. Novax must have a thick skin and exaggerated opinion of his popularity. Psychopathic traits.
I think he has damaged his brand immeasurably and he just does not see it. He will always be remembered for this fiasco over his many achievements, certainly the former will get a mention whenever the latter is reported. It is a situation of his own making.
That fella Tiley at the TA must be consider his position within the organisation.
