Is Australia under Montreal as yet or still under Warsaw?

Anyhoo the point is moot and not applicable to this thread.

As for the use of EU regulation; the flight is not 1) from an EU country and 2) not operated by an EU carrier, so EU regulations do not apply.

In any case, EU regulation 261/2004 provides for no regulated compensation if flights are cancelled and passengers are informed of the cancellation at least two weeks before the scheduled time of departure.

And as far as I know, there is nothing in the Montreal Convention (1999) or the amendments applied by Australian Government in 2008 to apply locally, that required or even implied any compensation for a schedule change. So again I ask how this applied to Clifford's unfortunate situation where a foreign (non-Australian) airline (3K) altered its schedule and did not offer a full and immediate refund? As much as that is very poor customer service, such poor customer service is not covered under the Montreal Convention.

Note that the wording of the 1999 Montreal Convention regarding delayed passengers (and in Clifford's case he has not yet flown so has not yet been delayed so this does not apply to him), "The carrier is liable for damage occasioned by the delay ..." (see Article 19). If there is no "damage" then there is no liability. Article 19 also sets out circumstances (admittedly vaguely) where the carrier is not liable for damage occasioned by the delay.

Before any claim could be made under Article 19, the passenger would need to show they experienced "damage occasioned by the delay" and any compensation payable would be limited to the cost of repairing the damage to a maximum of 4150 Special Drawing Rights. There is no automatic entitlement to a compensation payment following a delayed flight.

While possibly doesn't matter in this case, I understand that Singapore is a signatory to the Montreal convention, so I would have thought it would apply to 3k. Not that it matters in this particular case.

SYD-CHC-SYD on 10th Aug/17Aug for $265 (total)

Having looked at Jetstar flights I eventually booked with Qantas. Cheap Jetstar fares to Christchurch have a very inconvenient timetable, and better ones mean $380 for a return flight. Qantas' sale ticket is just $60 more but you get FF points and better service (in theory).

I'm still thinking about Syd/HNL , The surcharges and taxes appear to have halved. It cost me $336 per person in April this year and its showing $145 per person for May next year, doesn't sound like much but makes a difference over 4 fares. What was the big change in the taxes and charges?

I assume the figures you mention are just the "taxes and charges" component. I guess reductions in fuel might account for part of it, but airlines tend to just make things up as they go.

Yep ... interestingly they have already removed the fuel surcharges ...

When I checked SYD-HNL a few hours ago there had been no changes to the fare that has been showing since Sunday just past....

SYD-HNL is not listed in the "sales" ...

Adult $411
US PCASSF $4
US Int TT $22
US PFC $7
AU Int Passenger SC $23
Airfare per Adult $466
1 Adult Subtotal $466
But a HNL-SYD fare is not showing fuel fines ...

ok, that has obviously been updated since approx 11am

on the same base fare, $411 the total cost was $530'ish earlier

Any decent starclass fares around people have seen??

I've notived that sometimes starclass is cheaper than jetflex.. which seems strange to me.

Is anyone else getting the problem that emails received into gmail seem to consist only of the 'header'?

That only occurred whilst the recent StarClass specials were on, i.e. to HNL StarClass was $881+++ and JetFlex was $941+++

Sadly that and all other decent StarClas sales ended a few weeks ago and seem to be a little more expensive than what they were previously, even factoring in the removal of the fuel levy
