The court system sucks. But there is no perfect system unfortunately.

True, so the question is do you have no justice system (some would refer to this as anarchy), or which system do you accept which has the least amount of risk / flaw.

I think Japan is an example of a different system where justice is deliberated by judges. I think I remember the system being criticised in being biased against suspects, i.e. if you are suspected of committing a crime, you will find it very, very difficult to defend yourself, even if you are genuinely innocent. Wikivoyage does advise that if you are arrested in Japan, beware signing a confession, as you will be found guilty automatically without any further intervention and subsequently convicted.
 
Yes. It is so a case may be decided on its merits (just the facts) rather than any prior history. This avoids the "s/he has done it before so must have done it this time" argument.

yep. As I said earlier... The system isn't perfect but they try to come close. Just because Fred was jailed for burglary two years ago and is now released with the police knocking on his door anytime a robbery happens in the area doesn't mean he did it. The jury knowing this would be prejudiced and likely not assess a case correctly. We are talking about normal people who stereotype and are easily led.
A fair trial includes analysing the evidence independently of previous convictions.

For a potential jury member (and the people deciding who goes onto the jury), it would be also important to think about what the offence is. As a volunteer member of a fire service, I'd have to (or at least I should) disqualify myself from an arson trial. You'd have a hard time trying to find a fair jury for a trial of a rock spider.

I think you missed the part where the evidence needs to prove guilt. Hopefully that means that some offenders aren't found guilty rather than innocent people wrongly convicted.

In this particular example, it's called preventing a conflict of interest (potential or actual).

It would be like disqualifying myself if I knew the victim or defendant.
