Simingr, yes the Ombudsman sends people's letters to Exec Services who, in turn, asks the MR section for its response. So somehow the architects of these promos have input on the response given to the Ombudsman.

MR surely see they have a conflict of interest if Amex's terms or practices or amendments are found by regulators to be unfair, unconscionable, unenforceable, void, likely to mislead, etc.

(I have a feeling Amex is 'assisting enquiries' from invitees who feel aggrieved they were excluded from the uncapped 5/5 deal. One can imagine Amex faces a major payout id say ASIC made an adverse publicity order and asked for payouts).

Do you think MR should be involved at all?????

MR have a right of reply to any complaint made, and a chance to make things up to stop the complaint being escalated. I see MR and Amex as one and the same - not seperate entities.

Regarding "losses and damages", I have a hard time actually quantifying how people have lost money through this promo. Is the next step to charge Amex for interest payments on goods purchased on their card during this promo?

There is getting equitable justice and taking the p155. I suspect the latter is occurring when people start itemising surcharges for Amex card usage.

The idea of this promotion was to use your card more
HOWEVER
It did not say increase your spend AND use your card more

As I said I am getting points 5/10 by the looks of it and will continue to shop as much as possible this month
 
So is someone marketing person at Amex going to get fired over this one?

Must be somewhat of a debacle..
 
Well, like others on this Forum, my expectation from Amex's T&C's is that they should be posting the "unpaid" bonus points from Septembers' transactions by close of business today. If they don't then they are in breach of their own Terms & Conditions.

Well nothing new has posted to my account - and I assume your account.

I would expect that any points posted yesterday (bonus or otherwise), would be reflected online sometime today. Gives them until my normal MR posting today to get them in there!

I actually have some clear time today but the site is blocked by my company webfilters :(

In relation to whether onus points should or should not have posted I have found (and reported previously) that the posting time as moved from 9:10AM at the start of the promo to 1-2PM now so I would expect people to start the real angry posts around 3PM today...

The posting time does seem to vary from person to person. My MR points have typically posted a bit earlier than you have reported (between noon and 1 PM).

Still it is the last possible moment Amex have to comply with the T&C's (if you count from end of month, which in itself is arguable). I imagine posts and phone calls will be happening this afternoon!

Interestingly I had cause to ring Amex about an unrelated matter, and when I asked about the promo was offered to be put through to MR without the 'normal' CSR wanting to get too involved. My previous experience was that the CSR would ring the relevant department then after a 'short' period on hold would get back to you. Seems to have been a change in procedure there...
 
My husband just phoned to say he got a letter changing him from 5T/5K to 10T/5K retrospective to 1st Oct...so it is now in writing.
He enrolled ONCE pre Sep 20, no invite. He also was assured he was enrolled 5T/5K on 17th Nov.

Unfortunately he won't be home till later today so I can't give actual wording till then.

Maybe 30th Dec they will retrospectively decide he gets nothing?

Ah, now the retrospectivity begins. I was about to call them about points not crediting - instead I'll wait a little longer to see what letter I get and I will be calling them and then lodging the request through the BFSO shortly after that.

I suspected that they were planning to do this all along - hence those that were having points credited were only getting 10T/5K despite being told by CSRs at Amex that they were on 5T/5K.

The brawl is REALLY about to begin. I don't believe that they will be able to retrospectively put me on a different promotion to what I was registered on AND CONFIRMED to be on.

I have kept detailed notes (including PDFs of everything), and I will be looking to lodge it all very soon. Need to make the contact with Amex to complain about not getting 5T/5K and getting credited now, get the rejection (or no response) and then I'll head off to the BFSO.

Amex will have a HUGE fight on their hands. This is going to be very expensive for now. And what's more, like Lindsay, the ill will that they're now generating will mean that I will likely not have an Amex anymore after this promotion is over. I've pretty much had enough of this company. I used to think Amex were fantastic - no longer.

Ring ASIC 'Misconduct Breach Reporting" as well as the ACCC and BFSO: the ASIC Act also has laws about misleading promos and some compo sections for damages and losses if Amex contravenes laws. Back in mid Sept ASIC's Cheryl Wilson also said Amex can't rely on its 'we can change the terms if we feel like it' clauses: this promo was very obviously going to end in tears and, I suspect, Amex was boxed into not excluding non invited persons. She suggested the BFSO.

Advising that enrolled in 5T/5K when not invited so have been moved to 10T/5K. Advised that any points received prior to 30 Sept i can keep.

Hmm looks like they are taking a hard stand on this. Should be interesting. Should I write to them and ask for the points back that they took off me?

It also looks like they are still going through registrations and things. Does not bode well for points to be posted if they are still doing that.

On the plus side (for me anyway), I never enrolled in the 5T/5K promotions.
 
So the people who registered for multiple promotions are moved to 10T/5K "because you registered multiple times", whereas the people who only registered for 5T/5K are moved to 10T/5K "because you weren't invited".

I'm sure it won't be long before they start moving 5T/5K postcarded people to 10T/5K as well!
