vet, as per what simongr stated previously, Qantas, QFF or any other FF program has nothing to do with this offer.

Amex MR simply provides an outlet for the customer to direct MR points to other options.

i.e. complaints or further action can only be taken against Amex, trying to persue this with partners will be a waste of time.
 
Pages ago I gave the phone numbr for QFF Executive Services given to me by the Banking Ombudsman as the number they call.
Why on earth would anyone call QFF Executive Services about issues with this Amex promotion. It has absolutely nothing to do with QFF.

I was really angry because I enrolled with card and pre-20th. I am calling customers relations later to confirm the info :(
If you are really upset by the way Amex has treated you, remember there is always the option to cancel your card. Maybe if enough people walk away from Amex they will see they have created a problem.

Who cares about appropriateness, some people just want action! Vet also listed today tonight amongst the first people to contact regarding this promo.

I am thinking I will get my mum to write a note to Amex explaining why I can't comply with their new Ts&Cs and get an exemption.

Been checking posts over the weekend (feel well enough to post now - have an unexciting virus that has laid me low). Glad to see that things settled down all by themselves without any moderatorial influence (we do love self-moderating :D). That was until I read the posts on this page done whilst I was still typing

Looks like my wife's weekend shopping has shown up and we're well on the way to some October bonus points (notwithstanding the fact that we don't know when the bonus point are actually going to post)....

Well one thing about Amex's CSR's.

They have since almost the inception of the boom being lowered (roundabout Sept 20) c given out a stream of different and varied messages and answers......

How hard is it for Amex to write a few "scripts" for their staff to follow????

We could all cancel ours card, then close and delete this thread. That way Amex CSRs would have to worry for all the customers who left, and for finding something else to read on their lunch break LOL. :mrgreen:

Simon, the ff terms I read deem amex to be a party to the ff agreement, with rights to claw back, coupled with a no liability on claw backs clause in the ff company's favour. So ff off the bold bold bold.

Are you on drugs? Seriously? You start your posts in the thread bleating about how Amex should be subject to gaming laws as a CSR from Amex told you that you could immediately earn points and then you thought you could manipulate the DJ lottery by tarnsferring multiple lots of 2K points to DJ.

Now your claim is that we should call QFF to sort this even though the promo is between you and Amex and not QFF. I had my limited contract law knowledge served to me by Annonymouscoward who pointed out to me that my "contract" is with Amex and not the vendors - so I think the link between Amex's obligations and QFF under this promo are negligible at best.

Do you have any facts to help people understand the promo or are you happy posting irrelevant misinformation?

It is actually hard work keeping up with your posts to ensure that misinformation is clarified and people can base decisions on facts - which are sadly lacking from us, Amex and their CSRs.

In contrast to the DJ lotteries garbage and QFF terms, that part was actually worth reading.
The provisions of the ASIC Act apply to businesses providing financial services. The consumer protection provisions of the TPA (which have been quoted or referred to many times in this thread) DO NOT apply to financial services. Instead, the ASIC Act applies and vet hit the nail on the head with the provisions quoted.
 
Simon, .s52 TPA's anti misleading conduct section doesn't apply to financial service providers: see s51AF TPA. If you know the ACCC will, despite s51AF, take on Amex, what sections give it power. Conversely forumites might better their chances knowing about ASIC and s12DA et.al.

The FF provider's Terms I read define Program Partners as including amex and add them as parties to a tripartite party with the customer, and give it rights, as a joint and several party to the customer's contract, to claw back allocated points. But I suppose you're right.

But if perchance you're wrong, ff providers and their airlines should assess their liability if they ruin holidays by reversing points based on Amex's erroneous views. So maybe Amex wants to be very careful. And maybe Q and QFF should be leaning on Amex to sort out its own mess itself without claw backs of points held by program partners.

Your capacity to comprehend might be enhanced if you didn't waste time portraying your vituperative as intellectual superiority.
 
I don't know what this DJ Lottery is about. All I know is I got bonus points on the lottery's closing date plus extra bonus points on the bonuses they didn't transfer as 'lottery tickets' in time. I think that was fair compensation. But Simon knows everything so I must be wrong.

Most people here have been extremely tolerent of such posts by yourself and a few others. You have been given not so subtle suggestions about giving yourself an uppercut, you have been sent PM's to advise you how to get on better here and you still don't get it, do you :?:

The advice from NM is correct even if it's not what you think as the best or most appropriate for you, it could be the best option for someone else.

We are all entitled to our advice however it is inappropriate to attack individuals which you have done here again. In any case I'd suggest that taking on a moderator and the person with the highest post count on the forum really won't do your cause any good in the eyes of those reading your posts.

In case you had not noticed this is a Frequent Flyer forum NOT a bash up AMEX forum. Have a look futher around and maybe you will learn something.

My comment was a reference to your earlier comments in this thread suggesting that you were going to complain to a lotteries commission (or equivalent) about the conduct of the Velocity competition to win flights to LA that ended on 30 Sep.

Your position was that someone (maybe AMEX, maybe Velocity) had indicated that points would be transferred in one day. Since there was a delay in the accrual of bonus MR points as a consequence of the hiccups experienced by this promo, you started complaining.

I can't speak for your circumstances, but in respect of my MR account, my Velocity account and in respect of the terms that I think I have signed up to under this MYREWARD (or similar) promo (and those terms aren't clear - there are 2000 posts on the topic!), then you argument did not apply to the circumstances I found myself in and nor would it have applied to what I perceive the circumstances that would have applied to most others.

The terms that applied to me was that:

  • I have an MR account. This is a relationship with AMEX and me.
  • I have a Velocity account. This is a relationship with Virgin/Velocity and me.
  • I enrolled in the MYREWARD promo. This is between me and AMEX.
  • The terms given to me by AMEX for the MYREWARD promo (although not entirely clear) said that bonus points may take 6-8 to be credited to my MR account. This is something between me and AMEX only.
  • If I choose to transfer my points to any of the AMEX travel partners, then that i up to me. AMEX will process my request and (subject to the terms given when you make the transferral request) and gives an indicative time for the transfer to hit my Velocity account. For Velocity, the time to transfer is 1 day. Other partners like SPG take longer - maybe 2-3 days. The transferral of my MR account to my Velocity account is between AMEX and Velocity, after my initial request.
  • Virgin/Velocity had a promo that involved me getting entries in a prize sweepstakes/draw. Entry to the draw was achieved by transferral of points into my Velocity account. This prize draw promo was a relationship between me and Virgin/Velocity.
My understanding of your complaint was that you were complaining that you had not accrued the bonus points (which I was told may take 6-8 weeks) within 1 day. This is a different question as to whether the transfer from your MR account (of points already accrued) is effected by within one day, which I had been told it would be.

Thus, to me your suggestion of a complaint to a lotteries commision was misfounded. On the terms applicable to me, your complaint was analogous to claiming to the lotteries commision that Tatts/Keno/whatever was not treating you fairly because your employer had not paid you that week and you were unable to buy a ticket.

Actually, I said you *do* have a contract for supply of goods/services with the vendor (in return for payment).

You'd have a separate contract with Amex regarding the supply of credit (and your obligations to repay that, keep your card secure, etc - the T&C brochure they sent you)

The merchant/vendor would have another contract with Amex WRT to their finance facility.

What I was pointing out was that Amex's offer to give you extra, free, MR points isn't a contract (as far as I can tell). You aren't providing anything back in return (quid pro quo), and as such not enforceable under Common Law contract. (not to say that there aren't various piece of legislation passed by Parliament that might prevent Amex from reneging on their offer).

That all said, I agree with everything else you say, starting from:
