It is larceny by finding. Most crimes acts have this in them. Even if abandoned, which in this case I don't think they are, you have to make an attempt to find the owner before claiming a right to take possession. It is similar to picking up a tangible thing on the street and keeping it, or even taking something from the footpath that has been left out for a hard rubbish collection by the council. The owners have thrown it out, and effectively transferred ownership but it is still larceny. At what point is ownership transferred and to whom with amenities kits. It is an interesting argument and if it was argued in a court it would be so around definitions more so on anything else. People don't get convicted on the facts but the ability of their legal representative to argue the admissibility of the facts.

Via an implied term in the contract between the airline and the passenger. The customer is a potential passenger as they have not commenced travel.

I acknowledge that I am not accredited by the Law Society of New South Wales as an accredited expert in criminal law, but I have litigated a number of matters specifically in the area of abandonment in the NSW District court within the last 5 years.

In each of these cases my paying clients were successful. This is because I was able to persuade the court that I understand the legal principle of 'abandonment' in a superior manner to the prosecution.

So disappointing that the ill informed 'bush lawyers' also come out to criticise someone proving accurate information on an informed basis simply because they don't understand or like what the law actually says. Anyone claiming that the information I have provided is wrong manifestly demonstrates their ignorance of the law and an inability to accept that they are wrong.

And that's the end of my free legal advice.

Which customer? Who said there was ever a passenger for that seat. All we know is that the plane flew with no-one in the seats concerned.

What we are witnessing here is a whole new branch of law - the rights of imaginary, 'potential' customers'.

I acknowledge that I am not accredited by the Law Society of New South Wales as an accredited expert in criminal law, but I have litigated a number of matters specifically in the area of abandonment in the NSW District court within the last 5 years.

And that's the end of my free legal advice.

Please don't leave us hanging ... what's the law in respect to imaginary, 'potential' passengers?

Would views differ it was a business class passenger acquiring the unopened pack of seat mate vs Y passenger picking a few up as disembarking through the J cabin? Too be honest have thought of doing the former but the latter wouldn't even cross my mind ...
 
It's not stealing if you plan to do the right thing with it, and of course as long as it's genuinely thrown away by the airline and not reused. I am in the process of actively accruing as many amenity kits as I can, both personally when seated in premium cabins and from like-minded colleagues:

I go as far now as even taking my own soap to hotels, in order to pocket the unused amenities.

Oh, and in terms of the way I feel about Y pax taking PE & J amenities if they want to, my feelings are go for it. It's the same way I feel about letting in so-called 'untitled' people into lounges or to share any other benefits that a lot DYKWIAs just take for granted. I'll share whatever I can and I'll guest as many as I can as much as I can.

Yes, but I haven't made that move yet. Have been thinking about sourcing cheap amenity bags because while I can accrue lots of unused toiletries (from hotels) its the bags that are the problem.

My sister in law is a quilter and there is a Facebook page dedicated to people who make quilts and laundry bags for people serving in Australian defence services overseas. Last year the Founder was awarded an OBE? Maybe you could get a similar group happening? Just a good samaritan who thought the passenger left their amenity kit behind and so picked it up to hopefully reunite the passenger with it.

I don't do FacePimple and it won't let me go past some security check, but I'm sure its some good cause. Myself, I collect Business/First amenity kits & PJs (all unused!) and donate them to my local Women's Shelter. I usually ask for a ladies amenity kit rather than a gents when on board, explaining why and I am usually offered one or two extra.

Its not necessary to nick stuff (and I note the qualification you put in your post) to share stuff around.

I did that with the Tas QF manager some time ago, and eventually got the message back that QF already had links with a similar organisation in Sydney and not practical to do it from Tas (understandable). I should re-open that conversation to see what they actually do.

Sure they do. Judging by some of the cough I've found in or around my seat when boarding it doesn't appear that they are often frittering away their time by cleaning...

I am not an accredited "whatever", but I did in the past work at the pointy end of the law. I enjoy the discussions held here in relation to potential legal scenarios, but I can assure you, with 100% certainty, I would never have had the balls to charge a pax with theft for removing an unattended amenities kit. I would have lost all credibility instantly.

Despite many difficulties and legal failings and loopholes, the legal profession, as a general rule, are actually quite a down-to-earth and rational bunch. They would immediately recognize that the environment of airplane travel is special, and no one really knows what is ok and what is not. The courts wouldn't waste even two minutes on this sort of thing.

At the end of the day it is about common decency and manners. And airlines know that they have to put up with lots of different perceptions in their goal to sell cheap tickets to "anyone".
