Hi all,

Westfield shopping centre has display.
Tripped over the edge of display and knocked head on the ground.
Witnessed by security, a doctor(attended to injury) and general public....
Reported by security that others done the same.
Ambulance to emergency department to check on damage sustained.

So is there a case if not enough warning and OHS find that display has not taken reasonable precaution to prevent injury?
How much compo is standard for such a case considering shopping liability insurance?

Anywhere between whatever you're out of pocket in medical bills, to whatever your lawyer can net you (minus their cut).

In honesty, I don't know. Whilst you should likely make sure you confirm the details of the incident for information collecting purposes, you will be best to talk to a lawyer or OHS expert (not connected with the shopping centre) to confirm whether you have a case and what kind of compensation you could get, assuming that you are after some sort of compensation (particularly monetary, i.e. not just an apology / acknowledgement).

What kind of display was it? How was it laid out? How did you trip on the edge of it? Would a reasonable person think that you were too close to the display to cause injury to yourself? These and other questions will inevitably come up in discussions with your experts.

You will have a case but thanks to changes in public liability insurance following the terrorist attacks on 9/11 means any compensation will be limited.

There will likely be an element of this when it comes to how much liability is payable by the shopping centre, if any.

Whilst it is true that society in general should take more responsibility for its own actions rather than blaming and suing, there are still clear examples of where companies have not taken most reasonable steps to ensure that people are safe. However, seeing as I wasn't at this location, I wouldn't know the nature of the incident here.

So the people that lost toes to those fantastic furniture chairs should take responsibility for the poor design of those chairs?

NEARLY 100,000 dining chairs are set to be recalled by a major furniture retailer after two people had part of their toes cut off by sharp metal edges on the legs.

Doesn't some kind of negligence come into play? ie - not that something was there and you tripped over something but that it was in a position that you could not see it was there or something was say spilt and it should have been cleaned up and wasn't.

Quite good for me.

Have to be impressed with Bangkok Airways service. They picked up luggage from hotel yesterday lunchtime and was repaired and returned back to hotel last night. Can you imagine that happening in Australia on a Sunday?
 
It's been a funny few days for me, but I am now back at work - equilibrium is restored somewhat.

"Don't tell me how to manage my group!"
"How do you want me to deal with that situation?"

So your saying Westfield should take responsibility despite knowing they had a display they had previous problems with?

I am saying again for the record that a public display in a public place is different rule set as opposed to private furniture!

Furniture covered by warranty

Public display , liability insurance

Anyway my crystal ball doubts that much harm has come from it ?
