Joint bank accounts should not be frozen on death of one of the account holders. The Bank is in error. I've dealt with four estates so far as Executor.

One of the sons and mum in law went down there with the doctors death certificate and they were told they needed the official BDM certificate and she cant access her pension. Shes OK cash wise but thats not the point.

Frustrating as hell as even my own husband is piss weak on tackling this BS. Im ready to go down there and rage.
 
Last time we went to a brothel was in Kalgoorlie the night Skylab crash landed into Western Australia. We were on a private Learjet which was diverted to Kalgoorlie due to a fog at Perth Airport. The girls in our group asked questions while Moana showed us around her premises. It was quiet after midnight.
 
I had a chat to the ATO today,

After lodging one form they just phoned and said its better to do it this way, I got the impression it was a way to not have to do their work.

That is still wrong. I'd call the Bank Manager. She should still be able to access the joint account.

Which parts of the course about applying the legislative framework do you think are lacking?

Our legal system generally operates with a system of checks and balances. Just because police demand bail be refused may not mean that bail should be refused. We don't live in a police state where citizens have no right of review.

No doubt this will be a difficult time for those involved in the decision to grant bail, and the question will be whether they properly applied the framework. But that should be the subject of an investigation, not public witch hunt.

I have a feeling it depends on how the bank accounts were set up. If it is a joint account with both to sign and something happens to one of the signatories the account will be frozen until it is proven that the other party is no longer able to sign. This type of account was used many years ago but with the advent of cards I think it has pretty much been superseded.
 
I understand it was a bail justice - so a volunteer position without being a legal person. He was not before the courts for bail as he was bailed on a Saturday.

Many of those charged with serious offences are bailed, because if they are remanded in custody they may stay in jail for well over a year before their cases comes to trial.


Imagine being charged, spending 18 months in jail to be acquitted, having lost your job, reputation, self esteem and possibly your family and friends. Is that justice?

There will be lawyers reading this who will tut-tut and say outsiders don't understand the subtitles of the justice system. The irony is that lawyers who spend their professional careers examining the behaviour of others bristle at any form of external scrutiny.


And that is the problem. The legal system is far more of a closed shop than the most militant trade union. We are all prisoners of our past and most of us are change averse (this reporter has been accused of embracing change as much as a dinosaur welcomed the ice age) but the time has come to admit there must be a better way.

There are several issues relating to the justice system and the way that it fails all involved including the accused.

Where are the checks and balances in this volunteer framework? They have no legal qualifications. They are glorified JP's. Yet their tasks can be as onerous as those faced by Magistrates and Judges during the weekday. Victoria is the only state that deploys such a system.

If Denali's mother has a debit card to the account in her name then it's just one signatory. We've had that for our banks - forever. Or at least 38 years.:p.

Some accounts may be set up as either to operate and some as both to operate.

That may be (one of the) issues.

Decided to work from home today to deal with all the real estate stuff. The "description" lady came through before lunch. Photographer was due at noon but now coming at 7pm so plans for tonight went out the window. Plan guy has just finished measuring the whole property. Hoping this whole thing is over sooner rather than later, its hard to keep a 2-dog/1-cat house fur free for more than a few minutes.
 
Birth Death Marriages update. Our 3 week old application remains as "received" because despite father in law dying in November, the funeral home has registered, no required autopsy/police report ect, his death still isnt updated on their system.

8 weeks and still not on their system, so even if mum in law took the train into the city to get it, she would have been turned away.

But they took our $25 "prompt service" fee and wont refund it as they say they will action it within 4 days ONCE they are up to date on their paperwork. No idea when this will be.

Oh but somehow Centrelink is up to date on his death as their pension payment already changed, got a letter in the mail about that.

Yes that's the same as us but my grandmother was in the days of joint signatures on a withdrawal form or cheque. I remember as they had to wait for the death cert to free up the account. Certainly should not happen now though and very poor on the bank's part.

Yep, good luck on the fur front. I think cats sometimes derive a certain pleasure from coughing up a fur ball on newly cleaned carpet.
A friend's cat dismembered a bird behind the couch for her on Friday - lovely gift!
Considering the cat spends most of its time either inside or in its cat run the bird was very unlucky.

She coughed up two fur balls in the lounge the other night; warm weather has set off some impressing moulting. Fortunately shes down at mums till the photos are done. Dogs are banished outside.

Ergh, dont remind me. I'm horrified enough that the REA has keys. I've insisted that someone let me know before people are shown through. My home is my sanctuary and Im really uncomfortable with strangers poking around. Tempted to send all my jewellery back to mums to keep it safe, I'd hate for someone to help themselves.
