Problem being, the most desperate to come here will agree to pay the $20K via slave type labour... which Im sure already happens in some situations.
Sure, but such a penalty would be more than those in that type of situation could pay, so it would be less likely to occur.
 
If it was within the standard warranty period, sure. But, it's not, so... I'd go straight to Toshiba first.

I would be saying the reverse. If it is in the standard manufacture warranty period, go straight to the manufacturer. If it is not, and you are relying on consumer guarantee for faults , then that derives via the retailer, not the manufacturer. The Dutch have a good system. IIRC the person coming in, has to earn 1.5x the average salary to get a visa. This would kill Foreign IT firms that bring people on 50K a year.

Which would still allow companies to recruit top talent...
 
Because DJs sold it to me. I wouldn't tell one of my customers to deal with my supplier, so why would I? It's their job to deal with Toshiba, not mine.

Perhaps try the DJ's switchboard and ask them to direct you to the relevant department? When I had something similar the retailer tried to pass me to the manufacturer... they later agreed to take it but suggested 'it would take longer to repair', except there's a clause which says they cannot unreasonably delay repairs in this situation. They ended up fixing it in a couple days... same time as if I'd brought in a paid repair.

Agree it's easier to take it to a local DJs than have to muck around with postage to the manufacturer.
 
ACCC's advice of letter of demand is OTT - I'd only progress to that stage if you're not getting luck.

Wearing the hat of someone who works with consumer law and the second hat of someone who dealt directly with Toshiba over an issue vs the retailer - just give Toshiba a call, explain to them where you purchased it and the issue and seek their advice on having it inspected etc. They have a number of service centres in Melbourne: Service Centres :: Toshiba :: Laptops/Notebooks, Storage & Accessories so it can be dropped off and not posted.

You are otherwise going to go in circles at DJs, wait for them to figure out what to do and for them to contact the exact same people at Toshiba that you can contact!

Surely a phone call to Toshiba would at least indicate if they were worth dealing with in the first instance?

100% agree with this. A few minutes would determine if it was going to be quick and easy. If not, you can always write the letter.

I dont think so. Human trafficking exists in various forms, various repayments now. If you are told you can repay a $20K govt visa fee in 2yrs, some will be (are currently) prepared to come to this country, earn less, hand over their passport to whomever controls their visa paperwork ect to come here. Its happening now.

Yes I plan on giving Toshiba a quick call. I'm not that silly. But at the end of the day, my "contract" is with DJs...

In this situation, it would be easier in the first instance to take it up with Toshiba, rather than trying to prove a legal point. If Toshiba don't come to the party, then go down the letter of demand path.....

Anyway, legally, the manufacturer is just as much on the hook as the retailer.

Yes - but in the wilds of the Inner West in Sydney! My local butcher (a Peters I think) has it as a standard offering.
