Hell no. If I was told I could not take leave during the year (at times I want to travel) to ensure I had enough accrued to cover a forced shutdown then I would be finding a new job, with an employer who values AL for what it is intended I.e. a benefit for staff to ensure they are rested and refreshed in order to do their job efficiently and effectively.

Employees can be directed to take annual leave if the company shuts down over, for example, Christmas. This is to be reflected in your agreement when you start.

One option I hadn't thought of is the unpaid annual leave element (mentioned by Fairwork). So if you have used up your leave elsewhere then you have to take Christmas/New year unpaid.
 
Yes - I am well aware of the legal position re taking leave. And you'll find Xmas shutdown is not in majority of people's employment contracts directly (Awards may be different) as it is something which exists more as a policy (thus incorporated by reference).

Your response has gone on a different tangent to the response I provided - my comment was purely about not having leave granted during the year so as to have a leave balance for a compulsory shutdown.

Not that it is relevant to me, but the company I provide services for will allow salaried employees to go into negative leave situations if necessary during the formal shutdown..

I always allowed my staff to go negative on their leave (and not just for the shutdown period either). I also paid someone maternity leave after she found out she was pregnant 3 weeks after starting with me, I found if you looked after your staff they repaid you with genuine interest in their jobs and loyalty.

At the point we decided to shut down the business and retire, my main recruiter had been with me for over 20 years, which is almost unheard of in our industry.
 
If only a day or three, I will allow negative annual leave because its balanced within 1-2mths.

Not sick leave though. You can easily spot the very rare staff member that considers their sick leave as a day off per every month or so entitlement.

Sorry boss, can't come to work today, my arm fell off

I think I'd still be expected to attend tonight. After optimistically visiting several optometrists and making a spectacle of myself showing my broken glasses I nearly became unhinged when they all told me they were irreparable. I need an arm transplant from the same brand because the actual hinge fractured.

So back to work tonight with only one arm on my glasses and feeling slightly lopsided.

Mr Rabbit was not looking good the last few days. Having trouble with his back legs and wasn't able to clean himself anymore. Took him to the vet and she said it was time. Having him cremated and then we will scatter his ashes in the reserve. One dog is missing him quite badly. 11 and a half years is not a bad life for a rabbit. I put his longevity down to blueberries - he ate them every day.

It was and we had been putting it off, but on Thursday night he was looking so unhappy and his doggy friend was pawing at the door and howling and I think knew he wasn't well, so we took him in the next day.
 
It's been 25 yrs but I still remember when I had to stand there for our family pet. Toughest thing I've had to do and still sticks with me but their comfort came first.
