i called yesterday and they said it ended on march 15th and that they want me to show them proof. sent them the bing url and they said they couldnt access it and wanted an amex link.

You could first do a screen shot of the relevant bit of the caches page. Otherwise tell them

As list on the bing cached page. Then tell them that is where you found the terms and that as it is an Amex page they can look it up themselves.

Put the ball back in their court and ask them to show you proof the promotion was scheduled to end on 15th March. Tell them you want to see an Amex web site link that proves the Bing link Terms and Conditions are incorrect.

How could everyone here know the promotion was through to the end of June if the original information said 15th March. Surely we were not all mistaken when we read 30th June when we signed up?

Rubbish they are just trying to weasel out of it.

Print off a screen shot of the Bing webpage, that IS an Amex webpage and clearly states 30th June 2011. This time they pulled down the webpage so that they can try to hide the T&Cs.. Bit different to a few years ago where they kept changing the wording.......

The fact that they are now claiming an end date of 15th of March is irrelevant. Even a small T&C stating "promo periods may vary" is not relevant either.

They need to give you/us notice of the end of the promotion!

My bonus points were not awarded for my last transaction at DSE. Gave AMEX a call and of course got the usual response of promo has ended, etc. and that I needed to provide evidence of the offer. Thanks to whoever it was that posted the screen dump clearly outlining the promo end date of 30 June 2011. I have received verbal confirmation that my enrolment in the promotion will continue until 30 June 2011 :D.

Thats a good result but it really portrays AMEX as very unethical, things should not be so fluid and vague.
 
I have also now received verbal confirmation that the promotion does run til the 30th of June 2011, but that's only as I have the printout.... :shock:

And of course if they are going to play ethically, then all registered members should be reviewed to ensure they receive the bonus right through to the proper end of the promotion. But I expect we are all going to have to call to chase them up individually.

Courts like situations where someone is treated unfairly by being promised one thing and then given another or having it taken away in the terms and conditions, as does the ACCC. If the promotion says it ends on a set date then it needs to end on that date unless there is an unforeseen issue or mistake, being too popular is not something that is likely to fit into that category and trying to end a promotion on that basis would likely fall foul of the misleading and deceptive conduct provisions of the TPA.
I agree with you but there are always get out clauses on a lot of these marketing gimmicks.

How about a sale that ends on a specific date or until stocks last? How about an airline sale until a set date but they run out of the cheap airfares well befor the end of the sale? Are these examples any different to printing in the terms and conditions saying the terms and conditions can change without notice?

I would be calling them, but I am STILL waiting for a call back regarding missing Hotelclub points, and missing NIB points and now missing **** Smith points..

But I was told that I am still eligible for the points in the meantime from **** Smith!

They are still not gimmicks or get out clauses that are legal, in the case of while stocks last, its made very clear that there must be a reasonable stock available in the first place otherwise its bait advertising, same with an airline or any other company selling on the basis of an expiry or stock level closure. Saying on the other hand a promotion closes 30th June and then closing it early without any notice to the customers or logical reason given on face value is a possible TPA breach involving deceptive and misleading conduct. At all times both parties must act in good faith and fairness.

Correct - I know that airlines get into trouble (well they get named) when they have a big sale and their website crashes and/or they only have a very limited number of seats on sale!

The idea is to entice people into the store/website and then when they are "out of stock/sold out" the customer will buy something else at a higher $$$
 
I called Amex today and they said that the promotion mentioned finished on 31 December 2010. Yes I kniow we all get a different story.

Cannot get any confirmation that I am still on that promotion.

Apparently there were multiple promotions at the same time, postcard, over the phone and MR website.

Apparently anyone can still earn points at D!ick Smith until 30 June 2011 as long as the spend is $2000 or more.

Yes I know but the guy said I am, we are all, still eligible for the $5/$1 under the current bonus partner but that limit is $2,000 which is quite a lot.

If I have time I shall try a $150 transction this week and see how things go.
