What about fair work or perhaps the state government employment group? many moons ago, last century, a university decided to end my employment earlier than the 12 month contract period in about September or November. The project was basically dead in the water. Anyway. They did it on the Friday afternoon before I was due to go on leave. The notice period they gave me included that leave. When it came to the final pay they overpaid me by one week, matching the normal fortnightly pay period. Of course they tried to get the money back. The state government IR body was able to advise me that termination notice is not allowed to include periods of approved leave.
Not that my story is relevant to your situation, but they did provide useful general advice. Perhaps also for you?
I will be contacting fair work, but advice Ive had from the appropriate person at work is to turn up as normal on January 5 and advise HR that notice has not yet been given.
Had a meeting with my boss earlier and he outdid himself, demanding access to my email inbox after I leave. Not only illegal but against workplace policy.

I have a friend who is a workplace lawyer on behalf of clients treated unfairly and she is busier now that she has ever been. Re the emails, can your IT department access them anyway?
I went into a workplace once to bail them out of a sticky situation and the last person out the door had just been sacked on the spot for conflict of interest and deleted everything as he walked out the door. I soon got them all back though - I can't remember about the emails though. But I guess they are concerned that there's things in the emails that should also be available to other workers of a work nature.

Surely management has the right to monitor someone's business emails when they are on leave or leave the business?
All of our emails are shared and monitored when staff, including the CE and Directors, are absent so it's just what we do.
And yes, IT can control everyone's email box so probably best to stick with business style emails on business email addresses.

YES BC you need to be smarter than your employer - do not under any circumstances delete any emails.
One thing you should be doing for insurance is to take screen captures of your 'Inbox' right back to the day you were first alerted to you finishing with your employer - just insurance.
